    I'm sure I've heard that there is a limit on how long after purchase a company can charge for goods although I could be imagining it.

    Let's say that goods are purchased via credit card and the seller forgets to collect payment until 12 months later. Is there legislation that details how quickly payment should be taken?

    The moral arguments aside, is this sort of thing regulated?

    Yes, this is correct. When a retailer prices his goods he is technically inviting you to trade with him. If he has mispriced the goods he can change his mind before you finalise a deal. As previously stated, if it is common you should report him to Trading Standards.

    I absolutely accept the point about marked prices being an "offer to treat" but in the article it is stated "There is no contract until it has accepted the cash." This I do not believe to be true. It may be that the contract allows for COD or other deferred payment. The contract is made when an offer has been made by one party and accepted by the other.

    A consumer debt normally lapses 6 years after the debt was first owed or last acknowledged which ever is the later. Does this help?

  • I had both sets of rear wheel bearings replaced 15 months ago by a main dealer. Mileage at that time was about 65,000 miles. However, one side has gone again after approx 20,000 miles. The dealer said that the parts were only covered by a one year warranty so they would not replace them for free. I asked them to consider fitting them for free if I payed for the parts. They are still saying no. I feel that either there was a fault with the bearings or they where not fitted correctly. Can I claim that they were not fit for purpose and put pressure on them to replace them by suggesting I will go to the small claims court? The cost of replacement is £200.

    Not sure on the answer but if you go to an independent garage im sure you could probably half that £200 cost

    To cut a very very long story short, I placed an order for some integrated kitchen appliances with Boots Appliances online, on September 23rd, and paid for it immediately with a debit card (£1400 worth!). Almost instantly I got an email from them confirming my order, and stating ...."We have provisionally accepted your order and will contact you within 48 hours to confirm stock availability and a suitable delivery date. Payment for your order will only be taken once this has been advised...."
    I then got a phonecall from them saying that a couple of my things were out of stock, and would be back in between 7-10 working days, then someone would call to advise delivery dates etc.
    No-one ever called me back, so 10 days later I called them, and have been caling them every day since! What makes it worse is, they took the £1400 the second I ordered the goods online, so not only do I not have the items, I cant afford to buy them somewhere else! All they say is that someone from 'Out of Stock dept' will call me back. I've been very tolerant up to now, but I'm just about losing it. I've written to them asking them to deliver the goods which are in stock, but have had no reply. Apparently I get to speak to someone new each day, and I cant seem to get anywhere with them.

    23 days later, I'm now moving into my new home next week complete with a appliance free kitchen!

    Dixons were just as bad - I had massive problems in ordering a fridge freezer and cooker from them - they even told downright lies on the phone about some of their products. It really has taken the shine off a lovely new home.

    What do I do now? I need the appliances (the kitchen fitters have had to go away to another job, as they couldnt wait any longer, so more money for them to come back), but cant get anywhere with Boots?

    If you can get nowhere with the main dealer write to the manufacturer and send a copy of your letter to the dealer.
    Some manufacturers will take a dim view of a main dealer being so unhelpful.
