Yo! I brought my XBOX 360 from Currys in Jan 06. Its been playing up more recently by freezing and cannot read discs. Do I have to send it to Microsoft to be repaired or am I in my rights to take it back to Currys and ask for a replacement ? If it helps I have my receipt. Any help greatly received.0

It is up to Currys to deal with your problem. Don't let them put you off by telling you to deal with Miscosoft. Under the sale of Goods Act it is the retailer and not the manufacturer who is responsible.
If they offer to repair the X-Box tell them you will accept the repair subject to the unit being fully working on its return. Show them what the problem is and when they have repaired it check it in the shop before leaving to ensure it is working. If it doesn't tell them you want it replacing as 'not being of merchantable quality and not fit for purpose'

I am in dispute with a local shop over the supply of a mattress. Nat West Mastercard have stated that I am not protected because I took the goods from the shop instead of having it delivered. They are now referring this case internally to their 'Exceptions Dept' to see if a refund is possible.0

Tried to exchange and unwanted gift pack of Whisky Marmalade and Hip Flask in Boots today.
Was told that I couldn't have an exchange because it was food. It's not us I was told it is a health and safety thing.
I am sure I could return a jar of unopened marmalade to Asda so what is the difference I asked. It's not our rules I was told.
This was not only a sealed jar, but a sealed jar in an unopened pack.
Anyone know the lowdown on this please?0 -

Firstly, how much is this unwanted gift worth and is it worth the effort of pursuing it further? If you feel it is I suggest you contact their customer service department at Boots Head Office in Nottingham.
The other way out of this would be for you to give it to someone else as a gift.

No probs with keeping it myself and supplying the cash, but it just seemed an odd ruling. Perhaps supermarkets are happy to destroy returned food and carry the loss.
It was just one of those 'I want to know' moments.0 -
I wish I had read this article before trying to sort my sons phone out at carphone warehouse! Wonder now if I will have a case at the small claims as I have let them 'repair' it twice and they now say it is 'unrepairable'.Only bought in March and its been broken or in carphone warehouse for most of that time, cant get through on their ' customer care' line and the staff are unbelievably rude and unhelpful in the shop. Spent £90 and now have nothing to show for it, any help gratefully accepted, thanx0

Write to the head office and the branch pointing out that as they have had to repair the phone twice and now state it is unrepairable, it is not of merchantable quality nor fit for purpose and you demand a refund or a replacement.
Tell them that if the matter isn't sorted out within 14 days you will take them to the Small Claims Court.
If you hear nothing from them take them to court after the 14 days.
Send your letters recorded delivery.

Boots do not take food back and im sure it states this on the receipt as well, there are other places that have similar policys BHS is another i can think of0 -
Having read the article and browsed the postings I am almost certain of the consumer rights. But before I go in guns blazing, I would like a little confirmation or other pointers.
A friend who lives in Luton purchased from Toys R Us a Medion notebook in October 2005. Within 6 weeks it had problems and she went back to the shop and was told it was down to the manufacturer to sort it and not Toys R Us. When she told me this I said as far as I knew under the Sale of Goods Act it was down to the retailer but when she went back they refused to help.
The following is a short version of events:
The problems since purchase are:
Within 6 weeks of purchase the notebook would not charge the battery; nor would it work connected direct to the mains. After Toys R Us refused to assist and she returned it to the manufacture where it was away over the Xmas period for almost 4 weeks.
Shortly after this the problem returned and the manufacturer sent out a new connection lead.
Just before the end of the warranty in October the problem returned and the notebook was again returned to the manufacturer. When it was returned the keypad was loose (in fact actually comes away from the housing) and the keys do not respond. When the manufacturer was contacted was informed that it was out of warranty and any costs for repair would have to be paid for. On top of that they had completely wiped the hard drive resulting in the loss of some data but irreplaceable were around 200 digital photos taken during a recent family holiday.
And the crunch came on Sunday the 19th November when the original fault reappeared.
The question is does she pursue this with the retailer (Toys R Us) or the manufacturer (Medion). It is obvious (to me) that the good are and were faulty and at the very least she should have a replacement.
Have tried to keep this as short as possible, so thanks for reading and any advice would be greatly welcomed0
