I have had no joy from this company so have submited an oline aplication money claim on line. Bit worried as from their letter they have said its my fault that the ring wore in 2 weeks, not done this before but feel we are in the right to ask for a full refund. Any tips to help?

When you say you have submitted an online application money claim what do you mean? Is this through the courts?

Just to update My failed Plasma Screen after 28months thread
I wrote to Comet quoting the sale of goods act and claimed against them with regards to "Durability" of the TV, or rather lack of it.
Comet passed me on to their service department and they gave me 2 options:-
1) Have the TV repaired at a discounted rate (35%) due to it's age (would still have cost me well over £300)
2) pay a £75 labour charge (that's what the called it) and get a like for like replacement.
Obviously I chose no2. As they didn't have a TV to a similar spec and price, I chose a Toshiba 42 LCD TV and also got a PS3 with extra games and controller, HDMI lead and bluray r/c all for £110 more than the price of the Philips 37" plasma I replaced.

Do the same rights (sale of goods act as amended) still apply to the replacement TV as that has started playing up now after 17months. The digital terrestrial tuner seems to have died, so I have no TV on the digital side.:mad:
Edited to add:- I'll probably get them to come out and look at it and quote me for a repair. If it's upto about £100 I'll probably pay it, but if it's much over I'll probably go the sale of goods act route for durability again.0 -

With replacements all warranties and guarantees go from the date of the original purchase. Otherwise you could be getting new TVs from them for ever. Technically, you have had the TV for 4 years and I would expect them to make some sort of charge for repairs. This does not apply to the extras you received. These were new and should be dealt with as such if they fail.

Effectively the replacement was for a purchase you made 4 years ago and that is what would be considered in any claim if you went to the SCC. This is unless the retailer has indicated to you that you have a new warranty on the replacement. It's worth asking the question.
If you think about it you could have free TVs for life if you received a new warranty with each replacement.

I bought a refurb iPod Nano 3g for my DD for Xmas. When I opened it, it turned on but it was impossible to put the usb cable in it (yes I know the large end!). Apple collected it and replaced it with another refurbed iPod. This however will only turn on if its plugged into a power supply.
Where do I stand with regards to a refund? I've spoken to Indian call centre, UK repairer, US Replacements and US customer services in that order (two hour phone call) It bascially ends that they will only repair/replace the faulty Item which I don't want to do as it's obviously not fit for purpose. They said they would not refund as it's not their policy unless its within their 14 day timeline- do they have any choice as Ive let them repair the previous one.
I've though about small claims - any advice would be greatfully appreciated30th June 2021 completely debt free…. Downsized, reduced working hours and living the dream.0 -
Hi all
This is a bit of a delicate situation. My oh's mother drinks sometimes, and was due to come visit us in November, flying with EasyJet. Unfortunately, she was decreed unfit to fly as she had drank too much prior to attempting to board the flight. That was acceptable. She was then told by my oh to go home, sleep it off, and we would see her some other time. She decided however to buy a new ticket to fly in five hours, against our wishes.
My complaint here is she had been declared unfit to fly, which the EasyJet desk had been informed of, and yet she was able to purchase another ticket. One, she was grounded, surely she shouldn't have been able to purchase further flights for at least 24 hours? Two, the staff there knew she was inebriated, so surely, if nothing else, it's bad ethics to sell her a further ticket knowing full well that she will probably not be able to even board her next flight? She was hardly going to be sobered up in five hours.
I'm not particularly baying for blood on this, I just want to know who was right.

yes you are entitled to a replacement phone but from past evidence the phone shops are extremely difficult to deal with. They do not seem to know/care about customer rights.
A strongly worded letter initially to the CEO, Charles Dunstone may get you a result.

I'm assuming you bought this as a full working model in which case you are protected under the Sale of Goods Act. Send a recorded delivery letter rejecting the item as being 'unfit for purpose' under the SoGA and demand a replacement. If you paid by credit cardand the item was over 100 Pounds copy them and tell them you hold them equally liable. tell them you will go to the Small Claims Court if they don't deal with your problem satisfactorily.

My brother bought a HP printer from Staples (in store) about 6 months ago. For the past month it has been having paper jam and paper feed issues. What are his rights in regards to a refund or replacement with staples? Does he need to let Staples arrange a repair?0
