I bought a camera from Currys for my daughter on 18th October wrapped it up for Christmas and was first used on 25th December. The camera has a fault with not charging and closing itself down. I took it back to the shop today to be told as as it is over 28 days old it will have to be sent off to the Manufacturer for repair which will take up to 4 weeks. I asked for a replacement for another brand and was told to ring the manufacturer. They say they cannot do anything as it was not bought directly from them. Any advice please? Thanks Wendy
Your contract is with Currys and not the manufacturer. They are responsible for dealing with your problem. Write to them, recorded delivery, telling them that under the Sale of Goods Act they are responsible for sorting out the problem. Tell them that you want the problem sorted within 14 days or you will go to the Small Claims Court. Send a copy of your letter to the Head Office also.
It may be that the camera has to go back to the manufacturer but it is for Currys to sort this out.

I hope someone can help advise me on my rights. I'm drowning under piles of washing!
In october 2008 I bought a Hotpoint Washing Machine from Currys, and for the first couple of months it was fine, however it broke down on the 17th of December and I called an engineer out. The engineer had a look at the machine and gave me the bad news that the part he needed wouldn't be in stock until the 30th of December. I waited until the 30th of December and the engineer turned up as arranged but found that the part he came with was faulty. To add to the festive cheer he also informed me that the part he needed wasn't in stock and that he couldn't give me a date of when it would be in stock. He advised me that he had asked for a replacement machine but that it had been refused and that the only thing I could do would be to play merry hell with Hotpoint customer services and insist on a new machine. :mad: I did this and even cried on the phone, despite my blubbing they wouldn't budge. Today I went to Currys to complain, they called Hotpoint who said that the part they needed would be in stock tomorrow. Curry asked for an "Uplift number" to get me a new machine but they refused. I'm intending on calling Hotpoint back tomorrow to see if they can tell me when my machine will get fixed, but i want to be armed and ready with rights before i do so. I've read on the "Consumer Direct" website that A repair should be carried out within a reasonable period of time and without causing significant inconvenience. If this isn't done am I within my rights to insist on a new machine and to whom to I make the request? Being without a machine has caused me significant inconvenience, I have two small children, one is 2 and the other is 6 months and weaning so you can imagine that they hardly get though the day without their clothes needing a wash. It is hard enough getting out of the house let alone lugging washing around with me. I've spent about £30 at the launderette and have had to do my washing at 3 different relatives houses. Nothing else is getting done in the house as I am so busy trying to get my washing done.
If anyone out there can give me some advice I would be very very grateful!!!
P.s. I didn't take out any extra warranties
Firstly, it is Currys who are responsible for sorting out this problem and not Hotpoint. If you get the machine repaired in the next few days then at least you are back to normal again. If you don't, write, recorded delivery, to Currys pointing out that under the Sale of Goods Act they are responsible for resolving the problem and in view of the time you have been without a machine you want a replacement within 5 days or you will go to the Small Claims Court. Send a copy to their head office for the attention of their Chief Excecutive Officer. Also demand compensation for the amount of time you have been without a machine and the amount of money spent on getting your washing done elsewhere.
If you bought the machine with a credit card send a copy of your letter to your card company pointing out that under the Consumer Credit Act they are also liable and you expect them to assist in resolving your problem.

help, I saw a good deal on a tv on 27th dec it was advertised on the dixons website. So I bought it on my debit card. It stated the delivery would be within 14 days and I would receive 3 emails, the first confirming they had received the order, the second confirmed they had processed the order and the third confirming the delivery date.
I received the first 2 emails by the 29th dec and the money went from my account on that day.
I hadn't received confirmation of the delivery date so I phoned on fri 2nd jan and was told I would receive the TV before the 10th jan
I have now received an email this afternoon saying that they are having delays with receiving my item and the new delivery date will be the 1st march.
I don't think this is acceptable, surely the company must have known when I placed the order that it would take so long, and if not then they would have definitely known on fri when I called.
I'm now in a situation where they have £500 of my money and I have nothing to show for it!!
What's worse is I went yesterday and purchased a new TV stand for £100 and as my house is quite small its totally in the way, (it is unsuitable for the tv I currently have )
What are my rights? I still want the TV but I don't want to wait so long. Also with the credit crisis as it stands what happens if dixons go into administration like so many others

I bought some jeans from a small independant retailler on 16th Oct for £170 by credit card. Two months later a hole has developed in one of the knees where the material feels very thin. Normally jeans have lasted me years!
I have the credit card receipt and took them back to the shop and was told that I couldn't have a refund (The manager said that I must have tripped over and that's how the rip happened - this is not the case, tho I obviously I can't prove that!).
They said they knew their rights and would send them back to the manufacturer and if they got a refund, I could have one.
I didn't want to leave them so brought them home again. Any suggestions as to where I stand, is trading standards my best bet?
I appreciate any help

Of course you have a right to cancel and get a full refund but you don't want that.
Write to the CEO of Dixons pointing out your concerns and ask him if he can expedite the order for you. Once you have his reply you must then decide what you are going to do.
have you looked elsewhere for a similar TV?

Write to the manager pointing out that the jeans are not up to merchantable standard and you want a replacement/refund. Tell him that you will go to the Small Claims Court if he refuses. Make it clear that under the Sale of Goods Act it is the retailer who is responsible and not the manufacturer.
Copy your credit card company and ask them for their assistance.

Hi,
Can any one help me on my rights on this question.
I bought my wedding ring from beaverbrooks in June, and started to wear it on september the 5th when i got married. it is a white gold ring, and after a few weeks it became scrathched and the white coating came off after 1 month i returned it in November where i was told it was my fault that it came off. I have snet 2 letters of complaint to their head office and have now asked for a full refund as thye didnt tell me the ring would need recoating on a regular basis, my argument is that they failed to mention this to me therefore have missold me a ring with a valy of £399.00.
What can i do to get my refund?
Any coments would be helpful as i have never been down this road before

I have had no joy from this company so have submited an oline aplication money claim on line. Bit worried as from their letter they have said its my fault that the ring wore in 2 weeks, not done this before but feel we are in the right to ask for a full refund. Any tips to help?
