i tried to download a game on thursday from gameloft the first time i tried it came up error you have not been charged so i tried it once more and it said the same thing i then recieved 2 text message saying thankyou and you have been charged £3 i then called them and about 2 days later they sent the game i have told them they are charging me twice but they sent me an e mail saying they dont do refunds i have read there refund policy and this is what is says
Gameloft products can be selected as downloadable software from our online store. We accept absolutely no returns on game downloads. Should you be unable to download the game, select a game that is incompatible with your phone, lack sufficient credit to download it, or have a problem with your internet service, you will not be refunded. If you complete payment more than once, you will not be refunded. We reserve the right to replace your purchase with another game in exchange. If for any reason you do not receive the game or find yourself unable to install it because of a technical problem, we will gladly resend it and work with you to resolve the problem. However, once the game is successfully installed, we cannot resend it for any reason, unless you buy it again. One purchase entitles you to one download of the game to one phone number and on one phone model only. If you delete or otherwise remove the game from your phone, you will have to buy it again. is this legal? surely they cant make up you twice for something

If I had read their terms before ordering I would have left them alone. It appears you have fallen foul of their terms. If the amount is only £3 I suggest you write it off to experience.

If B & Q has a price guarantee then you might be able to claim a refund under this policy.

If they do not have such a policy you can't get a refund. If the price had gone up by £40 would you have paid them the difference?

My girlfriend bought a dress from Reiss for £165.

    It was this one:

    http://www.reiss.co.uk/gb-en/catalog.../8049-lavender

    299005_52_2.jpg

    She wore it only once.

    There are two problems.

The 'interface' around the neckline, which connects the heavy outer material to the light lining seems non existent, so when she wore it the outer lining kept weighing the dress down so the lining was appearing around the neck. This was really annoying for her, especially when she paid so much for it.

To add to the problems, it rained.

When she looked at the dress when she got in, it had watermarks all over it. i.e. you could see all the mark from the raindrops all over the dress from top to bottom.

We arranged to take it back to the shop, but stopped off at Johnsons the Cleaners first to possibly get the marks removed as we thought this would be the easiest problem to resolve... except it wasn't.

They told us they could do a silk spray clean, but it has risks!! 1. the material could change colour, 2. it could shrink.

So we said we'd leave it and go to the shop.

We went to the shop and explained the issue and they said that they don't deal with problems, they send the dress to Head Office. So we said OK.

Yesterday we received a letter from Reiss stating that there was no manufacturing fault with the dress, and could we email them an address to send it back to us!

So we have a £165 dress, with a strange neckline, and water marks all over it. We can do nothing to the neck and there is a real possibility of totaly ruining the dress should we get it cleaned.

Any ideas what rights we have?

    What can we do?

    Thanks.

    Peter

I am in the same situation as yourselves with REISS. My son purchased a Polo top for £59 and after 6 weeks we found the material had extensive holes in it. The item was sent to Head Office for inspection by the "Customer Service Team" and said that they could find no manufacturing fault and posted the item back to us. Can you tell me if you proceeded any further with your girlfriends dress or did you give up?

    Regards
    Julie

The dress is obviously not fit for purpose. Write to their head office and demand a refund stating that the goods are not of merchantable quality and not fit for purpose. Give them 7 days to deal with the issue or tell them you will go to the Small Claims Court.

my mom bought my daughter some shoes from a shop for a wedding she paid on a mastercard debit card. a couple of hours after wearing them at the wedding the tip of the heel fell off . my mom took the shoes back but they would not give a refund only offered to send them off to be repaired. i told her she was entitled to her money back as they were faulty and not fit for the purpose. she said that the man was quite nasty and would only give a repair.
i said i would go to collect them next week but wanted to clarify my rights. if as i think they will just hammer a new tip but the bottom of the heel had started to peel (patent shoes) and they look scruffy what rights have i got.
    did have the receipt

    thanks for any help

It's difficult to know without seeing the shoes. If they are genuinely faulty then a refund/repair/replacement would be correct.
If they have been worn and damaged then you are lucky to have the shop offer a free replacement. What is the shop saying about their decision?
