    Hi Matty,
    Under the Sale of Goods Act Amazon are responsible for the item and not M/S although if they have told you to send it to M/S they can do this but still be responsible.
    Make them aware that you expect the item to be repaired free of charge as it should not have failed in such a short time.

    If you send it back to M/S make them aware that you do not expect an item to fail after 16 months and you expect a repair/replacement or refund. The refund is unlikely after 16 months but would be from Amazon and not M/S.

    I had just bought 2 laptops from Dell costing over £1000 for the pair - when the following week I saw in the paper a deal where I could have saved £150. I feel pretty peeved - no one will return a call or email - finally got through to the call centre(in India) where the script wass repeated over & over - basically just bad timing!

    Any ideas or rights?

    What rights do you expect? You were clearly happy to buy 2 laptops at a certain price and shouldn't feel hard done by if they are reduced in price later. Technology does that.

    If they had gone up in price, would have offered to pay the extra?

    You may have the right to return the products under the Distance Selling Regulations but not if you have used them.

    Thanks! Do you work for Dell? I was just thinking - John Lewis - never knowingly undersold - or if you buy sale goods - it has been for sale at a higher price for a month, etc, etc. I wasn't perfectly happy to spend out alot of hard earned cash on laptops but needs must but hey could be worse.

    No I don't work for Dell.

    John Lewis' policy isn't a "right".

  • Bought some goods on the weekend and the money was taken off my card but due to high demand on the weekend their now out of stock and will refund the money.

    However just to rub salt in the wounds AFTER placing my order I kindly recommended a friend who ordered exactly the same item as myself and has had it delivered.

    Out of principle I don't want a refund cos it's too easy for the company plus the items were such a bargain it'll be harder so where do I stand?

    Write to the company outlining the facts and ask them to honour your order.

    i tried to download a game on thursday from gameloft the first time i tried it came up error you have not been charged so i tried it once more and it said the same thing i then recieved 2 text message saying thankyou and you have been charged £3 i then called them and about 2 days later they sent the game i have told them they are charging me twice but they sent me an e mail saying they dont do refunds i have read there refund policy and this is what is says
    Gameloft products can be selected as downloadable software from our online store. We accept absolutely no returns on game downloads. Should you be unable to download the game, select a game that is incompatible with your phone, lack sufficient credit to download it, or have a problem with your internet service, you will not be refunded. If you complete payment more than once, you will not be refunded. We reserve the right to replace your purchase with another game in exchange. If for any reason you do not receive the game or find yourself unable to install it because of a technical problem, we will gladly resend it and work with you to resolve the problem. However, once the game is successfully installed, we cannot resend it for any reason, unless you buy it again. One purchase entitles you to one download of the game to one phone number and on one phone model only. If you delete or otherwise remove the game from your phone, you will have to buy it again. is this legal? surely they cant make up you twice for something
