Thanks for your help, I'll bear the Section 75 rule in mind...

Phoned Consumer Direct as well and they advised the same, but could try Small Claim against the seller if they don't refund.
Interestingly if they don't collect the goods within 21 daysof cancellation I am within my rights to charge storage fees, which on a bed could be quite substantial!

Praise for Consumer Direct though, they were very knowledgeable and friendly, confirmed that I had done everything right so far. I'd definitely recommend people contact them if you are unsure of your rights at all.

But don't use their rip off 0845 number, use on of the following for your area; -

Consumer Direct is designed to operate from our 0845 number, so we cannot guarantee connectivity, but under many circumstances these landline numbers will work correctly.

    East of England: 01438 737460
    East Midlands: 01522 563000
    London: 020 8799 9200
    North-East: 01642 495600
    North-West: 01229 842203 020 31035167
    Scotland: 01851822401
    South East: 01622 626520
    South West: 01209 720333
    Wales (English language): 02920 367800
    Wales (Welsh language): 02920 367801
    West Midlands: 02476 786610
    Yorkshire and the Humber: 0113 201 3670

Consumers who call Consumer Direct from a mobile phone are handled personally. We will offer to text a landline number to consumers who call us from a mobile phone, and who live in an area that is served by Consumer Direct, because calls from mobile phones to 0845 numbers can be much more expensive.

    Hi all,

sorry if this is in the wrong place, I was just wondering if anyone could offer any advice...I was in a large chain store yesterday, and I was making several purchases, it was busy and I was stressed - not the greatest circumstances. But anyway when I got home I realised I'd been short changed by nearly £9, not a huge amount I know but still enough to want it back. I called the store, they said they'd have to cash up the till to see if it was over, which they don't do til Sunday night at a weekend, then they would ring me on monday and let me know.

My worry is if the till comes back as right, where do I stand? I know for definite I was short changed - I can tell because of the amount of money left in my purse - but should I just let it go? Or is there anything I can do?

    Many thanks

You must hope the store is honest and they have no other till problems to make your one disappear.

If they report that their till balances correctly you unfortunately can't do anything about it and you will have to write it off to experience unless you can prove it happened.

Let us know what they say when they call you.

  • Has anyone had any dealings with the above Co, please? They are an outlet dealership (housewares) - in my case, at the Ideal Home Exhibition.
I am in a dispute with them over a refund of an expensive kitchen aid that won't fulfill one of its advertised functions for which was the sole reason of my purchase.

Any feedback of personal experience or knowledge of this Co would be very much appreciated, please.
    Thank you.
  • martin- according to BBC2 Working Lunch prog tues 2nd banks issuing visa debit cards have to support their chargeback scheme which would appear to give a better level of consumer protection than credit cards. Have you investigated this. regards Alan

It does not "give a better level of consumer protection than credit cards." It can be a long drawn out procedure depending which bank you are with, as the programme showed re the viewer they mentioned, the bank they dealt with had "never heard of the charge back scheme"

Also it is only banks/Visa code of practice,(although according to the presenter who had contacted Visa, the banks are supposed to adhere to it), credit cards come under Consumer Credit Act Section 75, a LAW set in legislation.

Funny really when this has been going on since at least 2005; - "Working Lunch Visa debit card refunds"

And the updated version from September 2nd 2008

    Hi

I am considering starting small claims court proceedings against an ebay business seller (I'm outside of any ebay/paypal claim time periods) who has refused any refund or replacement for an electrical item which has failed after very little use in around 4 months. The amount involved is small but this has become more a matter of principle for me. I am aware I'll need to pay £30 up front and understand that this can be added to the claim

I have read up a bit about the procedure and it seems to me that even if you win, if the other party fails to pay, you then have to consider enforcement for which a further fee is payable.

My question is, can the enforcement fee then be made part of the claim in the same way as the initial £30 fee?

    Thanks
