do i have any recourse for compo, or anything at all, its so maddening when they give you a date, you take a days holiday and they dont arrive!!

bag of rats is what i say!!

    any help gratefully received:confused:

Have you really waited in all day? You posted your message at 1.35 pm. Have to spoken to Amazon if you have a problem and what have they said? They are normally very good on customer service.

Firstly, your contract is with Virgin and not Nintendo so insist they deal with your problem.

Secondly, it is not necessary to have a receipt. Any proof of purchase is acceptable and a card statement is more than acceptable.

Visit the store and tell them the product has failed and you expect them to repair or replace it for you under the guarantee. Under the Sale of Goods Act they are obliged to deal with this for you. If you have a problem with them come back to us here.

    Regards,
    Art.

    Yay Result

I rang Virgin Customer Services and worded it 'i bought a product from a megastore now its faulyy can i take back to a zavvi' they said yes of course you can, i went to the store this afternoon armed with my bank statement explained it was faulty they checked it out and then said do you have the receipt said no but i do have proof of purchase pointed it out and explained it was in a bundle and that i had already spoke to CS and they had said just bring it back (i know not exactly truthful) he then went to ring CS when he came back he said what do you actually want us to do so i said 'I want a replacement or repair' he said they don't do a repair service but i could have store credit for when they are back it stock or the money refunded to my card, so i took the money they gave £100 for a product retailing at £99.99 (i know only an extra penny but it all counts) and told me to keep the rest of the bundle, i am very very impressed with them especially the assistant who remained very helpful and friendly throughout, all i need now is a ds lite in stock somewhere:D

And a big thumbs up to Zavvi (Virgin Megastore) in Denton, Manchester

As they gave you a credit note (gift voucher) the guarantee on the second ring was in fact a continuation of the original one given with the first ring. When the second fault occurred you were outside your guarantee.

You will find it difficult if not impossible to argue that the rings had an inherent fault as the two rings were not the same.

The best bet is for you to contact the company and try to arrive at a more favourable cost of repair.

    Regards,

I hope I've put this in the right place?

I just wondered if anyone could help regarding the following:
My daughter bought a dvd recorder from Curry's I think it was. It was about £70. After 3 days it would not work snowy picture on some channels and no recorded picture at all on others. She took it back to the shop and was told that they were not very good and also would only record normal tv channels and not digital channels but this one would record neither of any sense where you could watch a recorded program. They said she could have a replacement but after being told that they weren't very good obviously she didn't want a replacement. The next priceband was £140 so she couldn't afford that, so they told her she would have to have a credit note/vouchers instead of her money back but not actual cash. So she accepted the vouchers, she's now stuck with £70 of vouchers she doesn't want or need to spend on anything and can't put towards a recorder as she can't afford the next model up. Sorry if this is sketchy details but I can only relate what I was told. Obviously this is like shutting the stable door after...... as she's accepted the vouchers now but can you tell me is this legal??
Any thoughts or help on this would be very appreciated.
    Thank you.

If she has bought the unit recently she is entitled to a full cash refund. Tell her to return to the store and say that under the Sale of goods Act the recorder was not fit for purpose and she demands a full refund or will pursue the matter in the Small claims court.

    regards,
    Art.

Many thanks for your help Art. She's only 20 and I guess they probably could fob her off easy enough. I will show her your post tomorrow and see if she wants me to go in with her.
