Vodafone change T&C's (Call charges) - Possible contract get-out??

If you look at your terms and conditions relating to clause 7a, you will see the following…
8) Ending of this Agreement
a) You may end this Agreement immediately by writing to us if:-
o we do not do what we have to do under this Agreement and do not put it right within 7 days of being asked in writing to do so;
o all of the Services are permanently no longer available to you;
o we increase the monthly (or other periodic line rental charge under clause 7a) and such increase (calculated as a percentage) is more than the increase in the Retail Prices Index Figure ("RPI", also calculated as a percentage) for the period from the month of the last increase (if any) to the month before we send the notice of the change in tariffs and you write to us before the increase takes effect. If we increase the monthly (or other periodic) line rental charge by more than the increase in the RPI we will tell you; or during the term.
In particular, this section…

Now, looking at the proposed prices…
1. Minimum Call Charge
Increase from 5p to 15p = 200%
2. Out of Bundle Rates
Increase from 10p to 15p = 50%
3. Non-Geographic Rates
Increase from 15p to 20p = 33% Increase
The current RPI is 4.6%, and as you can see, you will be increasing more than this, which relates to the clause in the contract as quoted above.
As this is way above the RPI and what I would deem as acceptable, I would therefore like you to cancel my Vodafone contract as of the 1st September 2008 using clause 8a within your own Terms & Conditions of the contract between us.
This should not incur any costs to myself, as this is a breach of contract by you as a company.
I use both the non-geographic numbers and out of bundle calls on a regular basis and I do not believe these increases will be of any benefit to me.
Please reply with confirmation of acceptance of the termination of my contract

You have to prove (based on YOUR previous usage) that your 'call or other usage charges' will increase by more than 10%baldly going on...0 -
I know this isnt ideal but i've had the same line from them saying they would look at septembers bill. Is there anything stopping me spending 10 quid on 0870 numbers in September? The problem is Jan Feb and March i spent 15 quid a month on extra calls but since then ive hardly used any.0

if u have made any calls to they numbers u shouldnt have a problem i made mine a few months back and gave me the same response as everyone else about terminationBetter to understand a little than to misunderstand a lot.0 -
I just spoke with a csa and he advised that i have to wait for septembers bill which will arrive in october. i need to calculate this and if the 10% increases are obvious, then i can cancel. cannot cancel until then though.
i hate this company and knew fi should never have taken a contract from them. rip off swines!!! its their fault they offered too good incentives to new customers and now everyone has to pay for their mistakes!!!0 -

Give them a call and ask them where in thier terms and conditions that it states you have to wait until the changes have taken effect. The terms and conditions explicitly state that call or other usage charges are based on previous usage
Vodafone are very good at stating it is in the 'terms and conditions' when you point out something that is blatently unfair (such as charging TWICE for returning calls through the voicemail).
It is time to make the terms and conditions work in your favour. Remeber the terms and conditions are not law, but they can't pick and choose what ones they choose to use.baldly going on...0 -

Good evening Mxx Xxxxxxxxxx,Thanks for your email to Vodafone about regarding the increase in your call charges due to the proposed changes.I understand that you are right in saying that the clause 8A in our Terms and Conditions states that you are allowed to cancel the contract without penalty if there is an increase in the call charges higher than 10%. However, as the increase would be effective 1st of September we'll not be able to cancel your contract without evaluating your bill once the new charges are effective.Mxx xxxxxxx, please note that we have not breached the Terms and Conditions as according to the Airtime Terms and Conditions [7(a)], Vodafone has the right to introduce new prices from time to time providing a 14-day prior notice.Please wait until the new charges are effective and we will then evaluate your bill and if your usage charges increase by more than 10% we will cancel your contract without penalty.I trust this response helps, do get back to me with any other queries you might have.
