    You have to realise that the FOS is similar to mediation. You have to look at what the bank said by saying no and argue that lifestyle event, ie loss of job etc,etc, lead to charges and an inability to pay priority creditors(mortgage.rent, council tax, utilities, etc,etc,) leading to arrears. If they agree a refund that is swallowed up by the charges then you have to argue that whilst the refund was nice on the one hand it did not improve the situation because either they didn't refund enough to alleviate your hardship or they did not suspend charges and interest allowing you to get on top of your finances. I hope that makes sense?

    Filed initial bank charges to claim in 2007. Am in hardship at the moment and have been for a while. I have a budget from CAB and sent this in to HSBC with letter stating CT arrears £330, Elec £160, gas £170, Rent arrears £200, water £179. they got back to me after 10 days offering £480 once i provide evidence of rent and water arrears plus £100 for 'essential living expenses for 2 months'. I am a single mum, 2 kids work part time. don't think £480 is really gonna help me enough bearing in mind that the charges claim is around £3000. I have telephoned and said that i appreciate the offer and the prompt response but asked if they can cover all my arrears (as stated above) so that i can move forward with my budget from the CAB. Anyone got any advice or had a similar experience. I do appreciate they're trying to help but i really do want to get out of this financial mess rather than a little token gesture that will help a bit but not enough.....

    Are you still incurring charges from them?
    Are any of the arrears being paid off?
    I like the offer but just wondering if we can get more. How much have the charges been in the last 12 months?

    No charges from them as account closed 2 years ago. water arrears being chipped into but not the others, only payments towards current usage on elec and gas, nothing on Ctax as they want £167pcm, waiting to hear if ent to help on that. Thanks NWSM, you've helped me before and you're helping again.=)

    personally,. I would be surprised if they increased their offer. I gotta say I am surprised they made the offer as usually many financial institutions say no. Are you still pursuing your current bank account provider?

    The account i have now is/was a parachute account with LLoyds tsb, i have not been charged anything with them to pursue them for a refund. Can I ask why you are surprised HSBC made an offer in the light of the hardship waiver and £3000 charges?

  • I have today recieved a letter from Metropolitan stating that

    ""HSBC have taken the exceptional view in respect of my account and will to hold recovery procedures pending a decision from the court case regarding the legality of bank charges"

    We trust that this now clarifies the matters and a apologise for the any confusion/inconvenience caused.

    Does this sound hopeful or I am daft?

    Obviously they did pay attention to my letter though.
    SPC £500 well will try very hard.

    So, basically, they're not chasing you for the money until the court case decision is reached....I guess that it does give you breathing space but they'll be chasing you again later for the full amount. Hopefully by then the decision will be in claimants favourand you'll be in a position to pay!!!yay!!

    Im new to the forum and have recently made a claim to natwest for approx £2000 for bank charges due to hardship. Not sure if i qualify as I dont have any 'priority debts' but am suffering as my wages have dropped considerably (commission based job).

    When I was with natwest my account defaulted as my outgoings were exceeding my incomings and eventually natwest closed my account and passed my debt to a debt collection agency.

    My partner then got me a loan to cover my debts and i am surviving (just), i still have the debt collection company chasing my for the £1500 I owed natwest. Ive filled in the expenditure form and sent copies of my wage slips to natwest proving how little money I have each month and also copies of letters from debt collection companies.

    Just wondered if you think im in with a chance?

    I applied to reclaim my charges from natwest under financial hardship and got a letter back this morning to fill in a Customer Financial Statements form. Now my Net income is £400 a month which is SMP someone told me not to put this down as it's not 'earnings' and someone else said put it down under the benefits section. Any advice?
