    Do you have priority debt arrears(mortgage/.rent, council tax, utilities)?

    I have no priority debt arrears but I am struggling to live off the surplus when I have paid my mortgage and my DMP.

    Can I be classed as in hardship because of this if I have no priority debt arrears?
    DMP May 08 - £27,000 approx!:eek: Debt free 2024!!

    In my case the FOS agreed with Halifax - I am claiming over £4k of bank charges - I am in arrears with my council tax, service charge, mortgage, gas, electric - everything. Have spent up on my one remaining credit card cos had to draw out cash. Queried the FOS and they said they would re-investigate my claim. However, because I am keeping my bank account "in a reasonable manner" Halifax won't refund my charges and the FOS have once again agreed. The fact that I'm keeping my bank account in a reasonable manner is because I've cancelled all my direct debits and standing order so as not to incur any more damn charges! Grrr............... I've now given up - it's a waste of my time and energy - I'm just going to wait for the outcome of the court case but I'm not very hopeful - these people have it all their own way and have too much power over ordinary people's lives and money!
  • my bank charges claim for £2,444 is with the ombudsman and they have accepted that i'm in financial hardship. H.S.B.C have made me a good will offer of £105. this is not my final offer the ombudsman said, this is only until the court hearing has finished. i have no interest in th £105 but would like to know if anybody has had the same circumstances as me, i would also like to know if i can disregaurd the £105 and still claim the total amount?

    Do you have credit cards/catalogue accounts or store card charges?
    You can claim the lot. I would say that you would be lucky if they agreed you are in hardship but ask them the question.

    Did you incur charges on the account recently?

    The bank do not have to pay even 1p under financial hardship. If you reject the offer then you get nothing to alleviate the financial hardship you have claimed to be under. Furthermore, do you have credit cards, store cards or catalogue charges you can reclaim as well?

  • Have just registered so first posting, hope I'm posting to the right place.
    Recieved an offer from the Natwest this morning, saying they are keen to resolve my complaint, and are happy to make an exceptional offer (their words) of £4359.00, which is half of my claim. This was offered under the terms of the financial hardship criteria. I rang the tel number given and told this would be paid into my old Natwest account which I thought was closed and money would be released at the natwests discretion to pay off any debts owed ie mortgage arrears gas elec etc. But I wouldn't be able to draw on it until they deemed all de.bts were covered as this was why the payment was being made (Just feels like big brother tactics and can't be trusted with my own money) maybe I can't but surely thats my choice. Is this legal or can I insist the money be paid into my new account .
    Going back to the letter, it also say's that once the legal proceedings are completed they will apply the findings to my test case and ensure that my acceptance of this payment does not prevent me from benefiting. If the legal decision is more advantageous to me.
    If anyone could advise me wether to accept the offer or not I would be very grateful. I rang the fos but they weren't much help to be honest.

  • Earlier this year I claimed my bank charges back under Financial Hardship .Natwest asked me to complete all the forms and return which I did immediatley.

    I then recieved a letter from Natwest stating that I was in financial hardship and that the team would be contacting me to make an offer.

    5 days late I had heard nothing from Natwest and rang them to ask for the progress.

    I was informed that the letter had been sent out in ERROR and that they had refused my I then recieved a letter to that effect.

    I have now written to the FO and enclosed the original letter and 2nd letter.

    I have been unable to find the original letter until today. Very stressed and worried.Tell me what you think?

    Do you have priority debt arrears(mortgage or rent, council tax, utilities)?
    When this year did you send the original letter because I think you need to complete a new Income and expenditure form if things have got worse.
