    It is not about the total charges or the amount that they gave, but the fact the account is closed. It is not contributing to your financial hardship today but historically may have. That was why I was surprised(pleasantly, I should add).

    I would be surprised but you now have the right to tell the DCA that you dispute the entirety of the amount owing and that under OFT debt collection guidelines they cannot chase a disputed debt.

  • I currently have a claim in with HSBC for charges dating back to last year. I have since received a holding letter like most pending the outcome of the test case. At this moment I am getting charged every month for going over my limit, these charges are because hsbc keep taking charges from the month before, again taking me back over the limit and ending me getting charged again! A never ending circle. Does anyone know if there is anything I can do about this? Thanks all :confused:

    They have sent me a leaflet outlining my income and expenditure but they dont want me to send it to them they want me to ring them with the information is this normal?

    I thought they would have to send me some kind of form to fill out.

    Also as I am on benefits can they take my overdraft off me?

    If you look at this post it is absolutely accurate. post 2 is probably relevant to you and no they are unlikely to take your overdraft off you.

    again I refer to post 2 and 3 for financial hardship claims. You need to include household income and expenditure.

    just and update ,my case is goin to an ombudsman for final decision , what does this mean?? iv got a strong case , even the guy i got on the phone from the fos said so ,but its being passed on and i have till the end of the month to send anymore info that would help my case
    i dont think there is anything else but does anyone know the kinda stuff that might help it rule in my favour???
