  • I'm aware of a retired lady, disabled and with very poor eyesight, who managed to lose her tenancy due to the Halifax taking all her pension money, and she ended up sleeping on the sofa of a friend. Oddly enough she was better off financially so the good old halifax decided that she wasn't in a bad enough state!

    Unfortunately I would agree with them when she did put in her complaint rather than when she was struggling within the tenancy. I would have probably have advised then about looking at a few other things if you had posted earlier cos I can think of a few people who might have wanted to hear this story.

    I think it means that they have all the available information to allow an ombudsman to make a decision so I would expect a few weeks(give or take a postal dispute) to have the decision.

    I am in a similar situation. I sent everything I had to the FOS (I and E form, all letters sent to the bank, copies of outstanding bills etc, another letter stating why I feel the bank made the wrong decision) and 2 and a half months later, I got a reply saying they agreed with the bank and that - in their eyes - my case with them was closed. I disputed this with the adjudicator dealing with my case and it has now been passed to another adjudicator who has said they will get back to me within 3 months!

    I am getting very frustrated with being shunted from one person/department to the next in what feels like a stalling exercise.

    I think you may be waiting for more than a few weeks. Hopefully you will be luckier than me though! At least someone said you had a good case.....

    hi can anyone give me some advice?
    I have two claims that I sent to nat west and barclays bank.
    With barclays I have sent off my first letter and they have cashed my £10 cheque for the statements, but the 40 days wait elapsed weeks ago and ive heard nothing. What should I do now?
    with nat west I have had statements back and sent in the letter claiming hardship[ my marriage had broken down and I have been left with a mountain of debts] and asking for my money back, but again the 14 days have well elapsed and I have heard nothing! What should I do now?
    neither claims are for more than a few hundred pounds each but i really need the money. thanks

    do u think theres anychance of me getting anything recalimed ?? iv got the bank on the fne telling me i owe them for loan and creditcard, and today they foned and said i have 14 days to pay 43quid or they will pass it on to there debt agency. i dont even know what or who i owe thw money 2 , i know the amounts for my loan and cc and its not them , can they actaualy get debt collectors in ?? do the banks know that it isgoing to the ombudsman ??? like has the fso told them its goin that far???

  • I applied to my B.S. to have my application for a refund immediately and received a form for such. On the form I stated that, since my original claim, I had become disabled and could work no longer and that I was in receipt of state benefits. They rejected my claim as not in immediate need!
  • I have been complaining through FOS regarding bank charges (over £6,000). My contact at the FOS says that although I am in financial hardship, they cannot force my bank to repay my charges because I owe them nothing. I went bankrupt and all debt was written off. I have tried reading the details of the waiver but can find nothing to support or go against this. Has anyone had anything similar?

    Do you have priority debt arrears(mortgage or rent), council tax, utilities)?
    Is the BS account your main account where those payments went out of?

    If you have been made bankrupt then it is game over on bank charges as any funds belong to the OR.
    If charges have been made since the date of bankruptcy then there may be a case but if not then you have no right to the funds.
