    I would say reclaim on the credit card charges and was there any PPI on the loan(s) including any old loans?

    1) chase barclays and ask them where they have sent the statements.
    2) The bank has 56 days to respond. Did you complete an income and expenditure form?

  • I am in a similar situation. I sent everything I had to the FOS (I and E form, all letters sent to the bank, copies of outstanding bills etc, another letter stating why I feel the bank made the wrong decision) and 2 and a half months later, I got a reply saying they agreed with the bank and that - in their eyes - my case with them was closed. I disputed this with the adjudicator dealing with my case and it has now been passed to another adjudicator who has said they will get back to me within 3 months!

    I am getting very frustrated with being shunted from one person/department to the next in what feels like a stalling exercise.

    I think you may be waiting for more than a few weeks. Hopefully you will be luckier than me though! At least someone said you had a good case.....

    Can I ask briefly whether your argument was one of two scenarios?
    1) The bank did not refund 100% of the charges so I want that?
    2) I was made unemployed on x date and the charges ate into my income causing charges leaving me unable to pay priority creditors(mortgage or rent, council tax, uitilities)?

    I received a letter from A&L stating that they have "agreed to refund fees of £440, which has now been credited to your account. The problem is that the charges came to £1257 (£1363.82 with interest). Later the letter states "We will keep your complaint file open for eight weeks to give you time to consider our response. If we have not heard from you in that time, we will consider your complaint over financial hardship closed".

    Now, I take it that I can reject this offer as unnacceptable, but will it then just enter the usual system until the test case is completed? I need a swift resolution as I am really in hardship, but I am not prepared to get screwed over just because they have seen an opportunity (basically that amount is almost enough to cover my overdraft).
    Any help would be greatly appreciated!

    Hi natweststaffmember, I don't have any priority debts. I'm on the verge of having them, but basically at the moment I am 2 months behind on my DMP and have had a final notice on a £3000+ overdraft.

    Were any non priority debts ie credit cards/store cards and catalogues included in the DMP?
    Have you considered reclaiming those charges as well?
    Is there anyway to avoid further action on the £3000.00 ie what does the £440.00 actually do for you?

    Have incurred charges since - one last week for £35.00 - bounced direct debit - one of the few I have left!

  • Am a Halifax customer....I have sadly been on Jobseekers allowance 7 out of the last 12 months,taking temp jobs when I can. I had given me when working £1000 overdraft, they just gave it me when I opened my account 5yrs ago.

    ANYWAY back on JSA,£60 pw again. A few times I have inadvertantly gone over my authorised overdraft by 28p-£2.80. Each time they charge me £35 and sometimes £28 on top. The transactions are normally for Debit card use where there is a delay in the cash coming out of my bank.

    I approached the Halifax who wouldn't help me, I explained the charges took half my weekly income and that the idea of a debit card was I thought that you could only use it in a store if the cash was in the account. No they said some stores allow up to £5 over and so it appears at the time you do have cash to cover.

    I appreciate the amounts may seem small to some,but on JSA your living hand to mouth and each £35 is a chunk of my income at present.

    I have gone to the Financial Ombudsman and am awaiting an outcome re the charges.

    I had another letter this week saying I had gone £2.60 over and another £35 was being charged, I had in fact gone 28p over for less than 24hours.

    PS.I am not reckless, I have downsized and gone from a 3 bed house to small 1 bed flat,sold my uneeded furniture etc that I have worked for and now even my utility bills are being paid weekly now.
