    I started my correspondence with nat West in August 09, I sent the first template letter from this website for financial hardship based on relationship breakdown and now having to bring up 2 young children on my own. They wrote to me within a week requesting i fill in a financial statement which I did. My Bank charges with them totalled £2110.00 plus interest at £629.69. They offered me as a gesture of goodwill £1510.00, which I replied to and requested £2,000. They stuck to their figure at £1510.00 and this I have now accepted as to be honest,its better for me to have £1510.00 in my bank account rather than £0. They also did stipulate that once the Courts decide on the Bank charges being legal or not, I could still reclaim the rest of the charges from them if applicable. And No I have checked in their letter that if the bank charges are legal under no circumstances have they stipulated they require the monies back.

    So thank you Martin Lewis and for your easy to follow guidelines, and also thank you to Nat West Bank.
  • That is a pile of crap from Halifax.
    FSA Waiver on bank charges point 13.16 states

    "(16) if the firm attempts to resolve a relevant charges complaint after 27 July 2007:
    (a) the firm must not seek agreement from the complainant that the resolution is in full and final settlement of the matter;"

    Whether the form was changed or not is completely irrelevant. Write to them again and state that they cannot make the offer a full and final settlement.

    Well its time for me to send off another letter the idiots at the Halifax, so much for Customer Relations.

    Can anyone help me!! I claimed under financial hardship with Barclays as my partner has just been declaired bankrupt and I am in mortgage and council tax arrears. Barclays credited both of my accounts with around £400 there was atleast £800 in charges on each. They didn't ask me if I would settle for this I just checked my account and the money was in. A few days later I received a letter telling me about this good will gesture. The money paid off some credit card arrears and my council tax, however since then I have been charged more fees (reserve fees of £22 per day) can they do this? The total charges on my account is £112 for one month and I'm going to end up in mortage and council tax arrears if this carries on.
    In my original letter I did ask for charges to my account to be stopped??
    I am going to call them and get rid of my reserve amount but is there anything else I can do.
    It just seems stupid I have just claimed from them a month ago and they are charging me again!!!

    Yes they can charge you but why did you pay credit card arrears? That is the next reclaiming bit you should be doing including the £12.00 since your credit card account was taken out. I would get rid of the personal reserve though.

    when a FOS adjudicator gets involved is there rough time limit that anyone can give me till it is sorted out as things are looking worse the longer it takes.

    The above link is to a kinda guide on financial hardship and the FOS which came from a few conversations I had with an ombudsman. I hope it is helpful

    im going through the fos at the moment , the bank offered me 170quid in total for my 2 accounts my claim was for 3000 but will now a around the 4k mark

    the fos said it was a fair offer :confused:,but the same month the bank took 240pounds of charges from me , so i wasnt really getting anything. still down 70 plus ill get charged on that, what can i say to make them see my point, all i want is another offer that would help me out .

    the fos said it was fair because it help me get my overdraft back up , which it wouldnt . im writing back to them but is there anything i can write that would help my case??

    btw he bank and fos have said im in hardship

    Do you have priority debt arrears(mortgage.rent, council tax, utilities)?
    Have they said that the bank would help you by increasing the overdraft or have done?
    I would make them aware of the additional charges which wipes out the refund and creates further hardship.

    i got letters saying i would be getting charged on like the 23 24 n 25th

    this was at the begining of the month , a few days after i got the offer in the post so they knew that the 170 would b pointless , i told the fos and they wrote and said the bank is acting in the right way ,so i phoned and basicly let rip ,i maybe shouldnt have but he said he would review my case again and get back to me , so i asked in a strong voice y the **** would it need to b reviewed again? cant some one do there job right


    any how that was 2wk ago and iv heard nothing from no1 so i was gon to email and apologise ant try and explain my point

    I wouldn't take out your frustration on the FOS because if the argument you went to them with was that it was not enough it isn't arguing how the charges put you in financial hardship and that is the argument you need to go with. Remember, the FSA Waiver on Bank Charges does not mean that the bank have to or will refund 100% of the charges, in fact, they do not have to refund even 1p of the charges but they can suspend charges and they can increase an overdraft to comply with the waiver. I think you need to ask the FOS to look at the fact that the offer is swallowed up by new charges and seek either increase in the offer or an offer that gives 3 months without charges to allow you to get back on your feet.
