HALIFAX - CLAIM - £5000 good will gesture £518
Just a couple of quick questions. I am just filling in my FOS complaint form, any tips for the extra details box other than those on martins guide ? Also, i sent a letter a few weeks ago saying i would accept a payment of the charges from when my circumstances changed. That was around £900 less than the total figure of bank charges. Therefore what amount should i fill in on the FOS form that i am claiming ? should i use the total from the point my circumstances changed as last asked for or should i now go back to claiming the total amount ?
1 last thing. The calculator on the MSE templates for bank charges, it works out the interest accrued for each individual charge. There is talk that you should claim %8 compensation as that is what a court would rule. I pressume this is not built in to the calculator and should be worked out at the end ? Since i did not realise about this 8% should i now add it to the total i am claiming on the FOS form ?

Extra bit of advice needed... When i started my claim with Halifax i also did so with a Natwest overdraft i have. The total charges total £1000. I have had 2 letters saying that i am not in hardship and to basically go away. Yesterday i received a letter from them explaining that the account has been stopped and all cards must be immediately returned, if not a charge of £125 would be taken to send enforcement officers to get them. They also want the £3000 overdraft paying in full in 14 days which is impossible otherwise they will take appropriate action. I wrote to them last explaining that i had already been deemed in hardship by halifax and enclosed a hand full of arrears and unpaid bills. I explained if they did not re look at my case i would go to the FOS. I feel under threat to get my account payed off and the letter is really nasty, im worried going to the FOS about this account is going to take too long as i only have 12 days left before procedings to obtain the money commence, bit worried about this one.
Any advice kindly received

Offer NatWest £1 a month until the conclusion of the OFT test case. Being deemed as being in financial hardship with one bank does not mean that you are in the category of financial hardship with the other bank.0 -

The second reference number Abbey have said will remain on hold pending the outcome of the test case, should I accept the offer they have made of £1245 or should I reject this and ask for ALL the charges from the last 6 years......now very confused as to what to do ..... PLEASE HELP ! ! !

What is the other reference number for? I am assuming you put in two claims, right?
Two different accounts?
I would accept the offer if it will ease your financial hardship because rejecting it could mean nothing. You can reclaim back to July 2001 until today's date.0 -
Hi thanks for the link. sorry if im being stupid. if i put £100 of charges in the calcul;ator dated 01/10/2009 for instance, it gives me interest of 0.27p. I heard a figure of 8% interest being banded around. Is this a calculator for statuatory interest and the 8% is for compensation or something ? with 8% that would be £8 interest for instance.0

8% is based on per year so the calculator is write but make sure you put the charges in individually....ie £38.00 unpaid for example then another £38.00 unpaid, etc, etc,0 -
Hi not written on here for a while, i sent claim in under hardship and got told that they dont think i am. Any way got a letter on Friday about mortgage saying that a defult notice has been given and its in frist stages of going to court for repossession. At my wits end now Halifax owe me nearly 5500.00 in charges and this would pay my arrears off and i wouldnt hopefully lose my house. Should i send a copy of this letter form the solicitors acting for my mortgage to halifax to see if they will change their mind , im not wanting money for holiday or any thing like that and i would be happy for them to send the money straight to my mortgage company. Pls advise anyone x0
