  • I'm on mix & match, which I signed up to right at the end of October 2007. I've not been notified by 3 about the change in billing. Reading this whole thread has been pretty confusing - can anyone advise me where I stand? Is there somewhere on the 3 website I can look to see the change in T&Cs in order to contact them about it?

It is now too late for you to cancel on the grounds of a change to your tariff - that took place last year for mix & match - by continuing to pay your bills without question you have accepted the change. (They will insist they informed you pre December 2007)

Where might I go to prove this please Jason?

To the best of my knowledge, the only people who can actually order them to change anything are the government. I don't think ofcom can order them to do anything, only fine them if they break the rules.

and there has been no government legislation or anything like that that would affect mobile phone companies.

Don't agree, but then you posted the same thing in this thread about 10 pages back and I never agreed then as well :)
  • OTELO have taken my case too, had a chat on the phone with a helpful and understanding bloke.

You don't have to wait 12 weeks if you have a deadlock letter, which I do.

Can't say too much as I don't want to help 3 out or be identified.

    Extraordinary!

My gf just got a letter informing her about the changes to her tariff and asked me to find out more (busy mothers don't have enough time for 3 CS!). Anyway, the first person I spoke to told me that BT made them put the prices up! Dismissing this as the talk of a loon I called again only to be told that Ofcom had made them do it! My third and final call resulted in me being told immediately that the changes were indeed detrimental and she could get her PAC free within the next month. He then put notes on her account to conform this should she wish to call back for just that reason...

Just what is going on here?

    my latest email from 3

Thank you for your email, in which you highlighted your continuing dissatisfaction with 3 and your request to cancel your account, due to a change in your Terms for 3 Services.

As subsequently advised by my colleague Lesley Dore, 3 added a term to the Pricing Guide on 25th October 2007, which informed customers that all calls made will be initially rounded to the first minute and billed per second thereafter.

This means that customers joining or upgrading with 3 after this date, are subject to, and would have agreed with, our new Terms for 3 Services, preventing cancellation without penalty on these grounds.

As you upgraded your account with 3 in January 2008, you would have agreed to the Terms for 3 Services in place at that time, which included this billing change. We are therefore unable to cancel your account at this time, without the applicable Early Termination Fee.

We would strongly refute your claims that 3 are proactively trying to delay customers from complaining about this issue. Customers who are affected by this change have and still are being dealt with effectively and in a timely manner.

With regards to your request for a Letter of Deadlock, I must advise that this will not be considered, as it is 3's belief that no state of deadlock exists in your case. As previously advised, this change was already in place and therefore would have no detrimental affect on you.

Thank you once again for bringing your concerns to my attention and I trust that this now reaffirms 3’s final position in this matter.

    Yours sincerely,

This email itself confirms their final say so could it be considered as a deadlock?

A deadlock letter confirms the deadlock position.

This email (which explains why there is no deadlock), goes further and actually denies there is a deadlock, so can't be considered a deadlock letter.
  • Has anyone else not received anything from 3 about this? Are they just targetting customers at random?
