    Can someone confirm something to me. If you bought a used car under warrenty and it developed faults early doors am I correct that oppurtunity has to be given to rectify faults using manufacturers warrenty (ie not at your expense) and only if they are not fixed or re-occur later down the line- 3 months etc- you can reject the car under SoGA?

    Thanks for your help Derrick, after 5 days of chasing up their lack of email response, and the 'all the managers are busy' scenario, I managed to get a miraculously free manager to pass on his wisdom to the C/S boy (after he told me to pay return postage & I would be refunded, and I told him I'd post it without payment if they refused to send a pre-paid bag for it), they are sending a courier tomorrow to collect it, and I am not ordering a replacement because they have been so utterly poor.

    Hi,
    I bought an energy saving plug board in Tesco in Dec 08 and when I took it back last week, as it doesn't work anymore, they said they are only giving a one month guarantee on all electrical items. Presumable this would apply if you spent a grand on a posh telly rather than 20 quid on a plug board, (it's one of those switch off standby things.) what a nuisance. Any suggestions? Louise

    Tesco guarantees all its electrical products for one year. If your product develops a fault please call our helpline. If we cannot immediately resolve the issue over the phone, we will arrange a prompt repair. If a repair is not possible, a replacement or refund will be offered. Small domestic appliances or DIY products may be returned without calling the helpline first

    Hi

    I bought a carpet two months ago which has developed wrinkles in it. Carpet fitter came out today to sort it and the carpet has lifted from the backing.

    Now this carpet was bought purely as I need a carpet that can be cleaned and is hard wearing ( I have two kids and two dogs). The claims on the advertising board with the samples stated it could be cleaned with bleach etc and was guaranteed to 10 years. I will get exact statements today as to what it claims.

    Where my carpet has lifted was where I had cleaned it with my vax upright carpet cleaner using vax carpet shampoo. The carpet wasn't left sodden or anything. The carpet backing where the cleaning took place as pretty much disintegrated into dust - its very evident when the carpet is lifted.

    What are my rights regarding this. In my opinion the carpet is not living up to its claims on the advertising and is not fit for purpose. I don't want to go to Carpet Right just yet without knowing my rights. I strongly suspect they will state that as the carpet has been cleaned then it is not their problem.

    I also paid for this with my credit card, so I hope to have some joy with them if Carpet Right refuse to help.

    Any help much appreciated.

    The technical term for what has happened to your carpet is delamination. It is a fault if caused by the adhesive that holds the backing in place has failed. It can fail due to water penetration. Ask the supplier to have it tested and see what this reveals.

  • Can anyone help? I bought a Sony Ericsson W380 mobile phone for my wife in October 2008 from an Orange shop. In December 2008 the screen stopped working so I returned the phone to the shop. They refused to replace it and eventually I agreed for them to send it away for repair. In January 2009 I went to the shop to collect it - and discovered they had lost it so was given a replacement!! This phone has now developed the same fault and the store will only send it away for repair if I pay a £15 admin fee. Surely under the SoGA they should replace or repair free of charge?

    No. Although it is a different phone you have had use of a phone since your original purchase in October 2008. Unless you can prove an inherent fault I would accept their offer.

  • I recently opted to purchase an Xbox360 game off TescoDirect for the illustrated price of £15; (it was being sold £35+ everywhere else). 2 days later, I received an email telling me that it was a misprint and that they were in fact not going to be selling me the item.

    My question is whether or not they have a legal obligation to give me the item at the price illustrated at the time, or whether they can actually refuse my order?
