Like you said, I did also notice that big different in the T&C. In my case, probably apply to all deals taken around Apr, one t&c sent via email saying:
"You have 30 days to submit your claim. (This bill must be no older than 28 days when we receive it)" Which is quite familiar
While the other (more interesting) shown on their website saying:
"You have 60 days to submit your claim. This bill must be no older than 60 days when we receive it" i.e. if you purchased on the 1st of April 2008, you need to send in a bill that is dated within September 2008, your claim window is 60 days from the date of that bill.
How did they calculate 6 months in the example??? Apr-Sept is only five... Doesn't matter. The important thing is according to this T&C I have 60 days claim windows and they accept the 60 days old bills.
Sure there is way around this but to be on the safe side, I will probably mail them and try to get them confirm the exact months in writing, which would be very useful should they reject my claims in 6 months time.
Did they provide t&a during the actual purchase, before completion? This is the one I would rely on.
Just wondering what a judge would say about contradictory t&a if one were to sue e2save?0 -
Yes. I think any judge would be most unimpressed by contradictory information and would like to think they would allow the most lenient t&c that were given. In any case, if it ever came to that I would decide on my strategy and arguments according to the individual circumstances and information. Aim 1 is to avoid the need - and I generally have. Aim 2 is to present a sound case should it be necessary - and I think I could do that.0

Yeah the one on the website was what I read and signed up for. But right after the completion of the purchase the email with name "IMPORTANT INFORMATION: Your Cheque Back Offer ID*****" came with the 2nd Ts&Cs which is totally contradicting with the 1st one :rotfl:
They are really misleading as ever ...0 -

My friend contract is coming to a close. He is currently on his 11th month of a 12 months contract, we just don't know how to claim the last piece of cashback (month 12). As he wants to cancel the deal at the end of 12 months but to claim the cashback as done as before he will have to send a bill arrives after 12 months which is the 13th bill. And of course there won't be the 13th bill if he cancel the deal at the end of 12 months.
Any advice would be very much appreciated.0 -
There will be a 13th bill. Don't wait until the 12th month or they will pay more than necessary. Presumably they are on cpw O2 - in which case you should read the relevant thread. Cancelling is not easy! At least, they try to make it hard - but it's not if you write to the address in the thread regardless of their lies on this matter!0

Thanks for the reply. I'm planning on purchasing a couple of phones for family members next week so good to know these details, that's if the t&a haven't changed by next week!
Having a look at e2save now and here's a full quote for instalment 1 (from order summary/description page just prior to checkout).Instalment 1 - You will need to claim by sending the bill dated 6 calendar months from the month that you received your handset and you have 60 days from this date to submit your claim. Send us your claim form and monthly bill showing your name, address, mobile number and tariff you are connected to. (This bill must be no older than 60 days when we receive it and have no balance brought forward.)
i.e. if you purchased on the 1st of April 2008, you need to send in a bill that is dated within September 2008, your claim window is 60 days from the date of that bill.
month 1 - April
month 2 - May
month 3 - June
month 4 - July
month 5 - August
month 6 - September
And they only provide a short t&a and no pdf compared to the old Price Match terms.0 -
That's incorrect methinks! This is complicated and historical - a mixture of E2Save and the old Onestopphoneshop way of doing things. Since E2save took over Onestopphoneshop you may think they use the E2Save way. Unfortunately the IIC moved from OSPS to E2Save just before the reorganisation - and they brought the OSPS way of doing things to E2Save. That's why they have gone from very good to very bad ever since!0

After writing the above, I realised it looked like the old check back calendar method from e2save and I did experience the problems with an old e2save contract being run according OSPS way - essentially ignoring the check back calendar. Managed to get the money in the end without suing.
So how do you interpret the 6 months and the within September example? Is it a case that I'm correct according to this t&a but they will follow 'their own' t&a? Or am I missing something?0 -
I think they ignore what they say and do things as before. Therefore it will be October. However, no problem in people sending a month early provided they keep their eyes on the ball and send again in October if necessary. I always keep my eye on the ball!0

If they reject September then LBA + MCOL? or to avoid MCOL send in October. At least there is 60 days from October bill if September gets rejected as too early.0
