Ebay item never arrived.....

Surely they (the seller) can just go on-line with the tracking number to see if it arrived, and if it didn't, then put a claim in with Royal Mail for lost postal item?
At the same time, start the "item not arrived" thing with paypal immediately, because it's highly unlikely to turn up now.
Thats fine if the seller posted the item recorded delivery, or Special Next day, but in my case it was posted just "normal" post so there is no tracking number. Not sure about the OP, but just my thoughts.

ok many on here are wrong actually , i suggest the op read the sellers conditions , proof of postage is enough that is all the seller requires should there be a dispute , the parcel once posted is the buyers not the sellers if the op goes to paypall , paypall will read the sellers wording if he has not been clear enough and stated he is not reasposable for items lost in post but retains proof of postage (all he needs to get when sending standard parcel )then PAYPAL WILL SIDE WITH HIM NOT THE BUYER it is the incorrect wording by the seller which caused a lot of fuss in the press recently as pay pall were winning disputes by default .even then if paypal win the dispute and the seller refuses to put funds in to his paypall account for a refund the seller will not get a refund as paypall will not refund any money out of theer own pocket as i have said all in the wording.0
-
i would also add most sellers have around three payapll accounts the powersellers more so if one account is frozen temp, they will just move payments to the other paypall account , people realy are a bit non clude up they need to do there home work even paypall do not do what it says on the tin i would never buy anything via paypall for an amount i couldnt afford to lose .0

its irrelivent what is put in the listing.
if the seller accepts PP then they accept the terms.
if they cannot prove reciept of the item then they would lose the claim.
of course the seller can claim via RM but for the buyer that is neither here nor there0 -
speaking as a platinum power seller i can asure it is what is in the listing with regards postage, if the buyer took the seller to court and the seller produces proof of postage then no refund would be ordered by the court , i would not allow myself to agree to any order by paypall if i didnt agree with them , i assume you mean pp is paypall why do you automatically assume paypall to be correct ??? paypall will not order a refund if as i have said is in the listing.
As per watchdog paypall are not all sweetness and light they will not honour the deal if a seller fails to send you an item and you complain to paypall they will if needed order the seller to refund, if how ever the seller keeps a minimum amount in his paypall account and refuses to abide by a paypall decision the buyer will not get a penny back as paypall will not pay him if the seller refuses point blank to pay up and the only way for a refund would be for the buyer to take the seller to court with no help what so ever from paypall, all my items are sent out recorded however if i had proof of postage i would not hand over a refund unless ordered by a court which they wouldnt order any way .0 -
so your happy for a cutomer to receive no refund or item?0
-
yes if i sent an item and aquired proof of postage which is offered by royal mail i would not issue a refund as stated once the item has left my building it is no longer my property the rm have a duty to ensure it is delivered hte main reason something is not delivered is theft followed by lost in limbo , this is why i send recorded i cant be bothered to argue , the people clearly know from the sellers postage and listing that no insurance is offered and i would have thought from the price of the postage charge it is not being sent recorded or special delivery .0

example when consumers can expect delivery of the goods or
the service to start. The contract should be performed within 30
days unless the parties agree to a different period. There is more
information on this at paragraph 3.16 under ‘Carrying out the
contract’.What if I am unable to deliver the goods or start a service in
the time agreed or within the 30 days statutory limit?
3.17 If you cannot meet the 30 day deadline to deliver the goods or
perform the service, you must inform the consumer before the expiry
of the deadline. You and the consumer may agree a revised date
for delivery of the goods or performance of the service. But the
consumer does not have to agree to a revised date. If they do not
agree to a revised date, the contract must be treated as if it had not
been made, apart from any rights that the consumer has under it as
the result of the non-performance.
3.18 If you are unable to meet the deadline and have not agreed an
alternative delivery date with the consumer, you must refund all
money paid in relation to the contract including the postage and
packaging. Please see paragraph 3.49 for information on additional
services that may have been provided under a different contract.
The refund should be made as quickly as possible and within a
maximum of 30 days.

need to either send new goods or offer the consumer a full refund,
including delivery charges. See paragraph 3.20 for more informationTHE_LONE_RANGER wrote: »once the item has left my building it is no longer my property the rm3.20 No. These items belong to you until they have been accepted by your

that you should bear. See paragraph 3.36 for more information
note this applies to business sellers, as a power selling im taking the assumption your classified as a business seller (selling in the course of business)Yes Your Dukeiness0 -
yes registered as a business seller ,and have been for 4 years, 2 years ago a buyer took me to court i won contrary to what is printed above clearly the county court judge need to brush up on his act .
from then on all items were sent recorded as i have said paypall cant order anything if the seller refuses to refund only a court can do this .0
