The story:
Started claim in April 2007, originally totted up to almost £5,000 so sent letter asking for full amount. Didn't hear back from them so wrote threatening court action and saying we would settle for £4,500.
2 weeks later had reply offering us £3,500. Not the amount we originally asked for but due to personal finance situation we decided to accept. The money was in the bank 14 days after we sent agreement (26/07/07)
HSBC have been very 'nice' during the whole claim and although we did set up another account just in case they turned nasty we are actually still doing some banking with them!

I had my court case on 17th Aug at Birkenhead CC. I'd received the standard letter from Abbey saying they were going to apply for a stay so I wasn't expecting to come away happy.There were about 20 other people waiting and all the Banks representatives were seeing them one by one before going into the Judge to advise them that they would be asking for a stay - Nobody came over to me though so I wasn't too sure who I was up against, there was an Abbey Barrister there but I wasn't on her list (I heard her talking to the clerk).About 6 people went in before me and all came out looking fairly glum so I think the Judge must have stayed their cases. However, when it was my turn I found out that there was nobody from Abbey to deal with my case and went in to face the Judge alone. She told me that as Abbey hadn't turned up to defend against me that she would be finding in my favour, but, had Abbey turned up she would have granted a stay as that was what they were all doing until after the Test Case. While all this was going on I had one ear on the door in case the Abbey Barrister who was there (but without me on her list) decided to jump in at the last minute - I was sweating I can tell you!So judgement went in my favour and the Judge stated that Abbey had to pay me £2768.00 plus costs by 7th Sept 07. I'm still kicking myself, can't believe how lucky I was, just hoping now that Abbey pay up in time, don't fancy having to get the Bailiffs out to them!So thank you Martin and everyone else here, you're help and advice has been invaluable.Also, must say that it seemed a few people never turned up on the 17th, perhaps they thought they needn't bother with the stays being applied, but it just goes to show, had I thought the same I wouldn't be jumping for joy now!!Almost forgot to tell you about my Credit Card charges success too. I started this after I started the Bank charges reclaim, again with Abbey. Sent in the usual letter asking for them back, got told "no". Then got a letter giving me a £350 Goodwill Gesture (I was claiming £950 in total). Took that but told them I would still be applying for the rest through the courts. Never even got to the MCOL stage - just as I was about to send them a LBA letter, I received a letter saying they would pay a further £600 in full and final settlement - you could have knocked me down with a feather1 I got my money back with virtually no fight!So keep it up everyone, and good luck to all those who have had their cases stayed - I'm sure it will work out in the end!0

After writing to Nationwide and asking for money, and getting turned down. We decided to go through the ombudsman. They were great and within a few weeks we had offer and accepted it! (A day before the OFT froze claims!) We have just received a letter from Natonwide thanking us for accepting offer and money will be in bank within 10 days. They are not going to close our account which I am very surprised at. Very Happy!!!:j0 -
Asked for 320 and got 320 .
Really pleased as I had received the stalling letter from the bank 'we will investigate your complaint ...' and I was using this time to ponder whether it was worth pushing on with court action. Any way 4-5 weeks later I receive a letter offering me the whole amount as a gesture of goodwill. So it was painless and worthwhile for me.0 -

I read all the info on this site and decided to reclaim all those charges. Fair enough I was to blame for some of the charges. I was not managing my finances very well at the time and they let me go over the £3500 credit limit on my Platinum Card. I consolidated finances and got sorted out but that was about 4 years ago. When I read the info Martin had put on this site I decided that I really had been stung with the charges so I sent the first letter with a cheque for £10. They replied with a list of all charges and to my amazement my cheque returned as well.
I used the calculator on the site and sent the next letter, I had almost lost hope as they did not reply so I gave them 1 week after the date requested for them to reply and phoned them. They told me they was 2 weeks behind. I said not my problem. A couple of days later I got a letter stating that they fully stand by their charges and don't think they were unfair quoting contracts etc. but her is a Goodwill Gesture of £610 and if they don't hear anything within 8 weeks the matter will be closed. Thank you very much I banked the cheque and spent it. I was pondering whether to pursue the rest with having spent the first money they sent. But then I read that the OFT stand a good chance (100% hit rate). So after 7 weeks I sent the letter asking for full amount or the OFT will be involved instead of the courts. I did put that I was willing to accept 25% less than the full £1600. I had almost given up again as not hearing from them.. and low and behold they sent me a letter still standing by their charges and the OFT's ruling is unfair but here's another cheque for a further £629 to finalise this matter... Happy days I'll accept that as final payment...just waiting for the cheque now..

Well at last after a lot of phonecalls and faxes to the chief exec office I received a payout of £1027 from RBS on Friday( they have by far best customer service as far as I'm concerned) and have another one on way from LTSB for £319 through FOS (this bank have been most unhelpful with me). Thankyou to everyone on this site for the invaluable advice and for helping keep it going when you feel like giving up!Have few more claims to go and I've certainly learned to watch the pennies in future! Thanks to Martin for helping so many people like me get back on track xx

Received £5600!!!!
Started claim way back in February received usual "not a chance our charges are fair" letter - issued proceedings beginning of April. They defended the claim and was transferred to local CC. They were asked to provide amended Defence and accepted my offer of £5600 the day before the test case was announced!!!! Money was in my account within 3 days!! Would have posted earlier but have been too busy doing up my house!

I received the standard "we hope you accept this (measley) £1380 as a goodwill gesture" letter and after reading some advice on this site, spoke to a nice guy called Nick who happily re-negotiated £2000 for me. It was paid into my account within 5 days!
