    I started the process in February and the bank delayed so I started the court process. After a bit of posturing the bank sent me a cheque just 3 days after saying they would defend the claim. It does seem that they don't want my custom any more though. Who cares, plenty more banks out there.

    SLightly less than the claim as I had not accounted for a £45 refund ona charge in 2003. This was a claim on an account I closed in January of this year.

  • Hooray and thanks. Three days before their defence was due, HBOS refunded the charges to my current account, credit card, interest and court fees - £780.82 in total. I was really, realy chuffed until I remembered they shouldn't have taken them in the first place. Like most of you, I was a good customer (of Bank of Scotland). However, ocasionally, I slipped over my overdraft limit (sometimes because the DD to BofS CC was taken early!) but sometimes it was my fault and I was charged interest and multiple penalties. Similarly, sometimes I forgot to pay my CC bill by the right day for which I was charged interest (rightly) and silly late payment fees (wrongly). My claim was settled in full 3 days before the defence deadline.

    TIP: BofS is/was Scottish and their Head Ofice is still there. THerefore, if you give that address you can't use moneyclaim online from HMCS (a great service). To avoid this, simply put your local branch as the address but claim against 'The Governor and Company of the Bank of Scotland'. This is acceptable and I have shown it works.

    The bank's solicitors have not, of course, accepted liability and have insisted that the terms are correct and I am bound by them. Clearly they don't believe this or they would not continue to settle claims like mine. Despite the fact they would have to spend more than the value of a claim like mine to defend it, if they believed in their case, they would pursue it on at least one occasion to make their point and set an example.

    It took 8 weeks from my letter being received by the HSBC, they responded with the letter saying they were investigating.
    I copied them with statements and an excel spreasheet that had taken me 3 hours to put together. I followed up with a phone call, and confirmation of reciept.
    They then sent an offer to me of £2300.00 i have accepted, many thanks for this wonderful site and the forums within it. This is helping our whole family put our finances back on track.WONDERFUL.

    I sent a letter to Natwest asking for my charges and interest back, I wasn't too hopeful that I'd get it without a fight, I received a letter 2 weeks after I wrote to them saying that they feel the charges are lawful and blah blah, then I turned the page to see that they would however offer me the £295 as long as I take no further action and they accept no blame. I was more than happy to accept this as this was what they had taken from me in the first place and I wont have to write any further letters. Great! :j I suggest everyone tries this, it may not be so easy for everyone but it's gotta be worth a try! :beer:

    Got a letter on Thursday from Barclays refunding charges of £390 after I sent a first letter from the CAG site about the charges being unlawful. Whole thing took three weeks in all, was expecting it to drag on for ages. They didn't even close my account and they've paid the money into it.

    Still waiting on HSBC... Will now get to tackling my mum's as she must have paid thousands over the years as she's very bad with finances...

    owed me £1545 in unfair charges
    offered me £1360 which I declined
    I asked for £1600 which they declined
    I told them I would be happy with £1580 (they said yes)
    (I added on two more charges I'd been charged during the process)

    I really did chuckle to myself though- I rang them- about a settlement- they kept telling me that they were busy, had a backlog, that they had needed to take on extra staff etc, so i promptly told them that if they hadnt acted unlawfully in the first place then they wouldnt be in the position that theyre in!!

NO PROBLEMS, FROM FIRST LETTER TO IN MYACCOUNT 8WEEKS NO MENTION OF SHUTING MY ACCOUNT OR OVERDRAFT DOWN.JUST FOLLOWED ALL YOUR INSTRUCTIONS STOP ON.........NOW MY FAMILY WANT ME TO HELP THEM TO, SO HOPE ITS AS EASY AS MINE KEEP YOU POSTED....
