    Story:
    We got through all the stages up to and including being given a date for court hearing (26th March 2007)
    It was a great deal of work ! and I was constantly nervous that I would do something wrong and the case would be `struck` out by the judge cos I had forgotten to do something.
    The bank argued that we had not provided sufficient details for them to offer a full defence and wanted to know details of which clauses we were accusing them of breaching from which laws etc, Loads of research needed to answer.
    Used the Order for Directions from web site and was prepared to supply the agreed evidence, past cases etc, (the 40 odd page document)but it was not issued by Judge.
    Then today got a cheque !!!!! On condition I don't disclose the fact of or disclose the details relating to this payment.

    Well never mind I,ve told you now !

    It surely must be one of the largest claims

    Can I legally post the fact that the bank paid the full amount ?

    thank you Martin and your team. the business was almost bankrupt because of these unfair charges which we could not escape from, until NOW !!!

    3 letters telling me that they feel their charges are fair and transparent. took them to court and won funnily enough.

    Amount Reclaimed: £445
    Amount they paid: £467.27


    The story: Applied for a mortgage in Jan 06, arrangement fee was £445 to secure the product and arrange the mortgage. The Woolwich cashed the cheque and declined the mortgage at the application stage.
    Took 3 phone calls and 2 letters.. 2nd letter threatened to lodge a small claim in county court. The Woolwich paid out within a week and included 5% interest!!!

    Amount asked for = £4150
    Amount recived = £4047

    What a result was just in the process of setting up a court date and recived an offer in the post. Its all well and good claiming the money back but when are the banks going to realise that what their doing is wrong and slash the amount of the fees!

  • I am owed approx £700, and have posted a letter to my bank HSBC asking for 6 years worth of statements after calculating the amount i wrote them a letter to ask for a refund and they got back to me 6 weeks later stating they need a full breakdown from me of all charges before they would consider anything...is this right?should they not have this on record,im not sure if i need to just continue with the template letters or should I go through all my bank statements and get all the dates,amounts and reasons as they are asking. Can someone help pleeeeease???

    Right, now thats off my chest the question i would like answering if possible is this: I am attempting to claim about £1800 pound back from the Halifax. I have followed Martins advice to the letter, using all supplied templates. I have got to stage 3 where i have sent the letter asking for my money back and have recieived a reply, part of which i will now quote.

    "We are sorry to hear that you are unhappy with the charges debited to your bank account. Please note the complaint handling rules set by our regulator, the FSA, gives us 8 weeks to investigate and respond to complaints."

    It then goes on to say they will be carrying out a thourough investigation, and if they are unable to respond fully to my concerns they will contact me within the next 4 weeks to update me of their progress.

    Now... having had my card cloned about 4 years ago i know how quick the Halifax work and that took nearly 6 months to sort!

    What do i do folks, do i sit back and relax and let the process take its course, or do i fire a broadside and go to stage 4....

    All sensible replies, gladly accepted.

    I got the same letter from Halifax and i wasnt impressed!! Its a delay tactic so just ignore it and go to the next stage. I actually went straight to the MCOL stage and on reflection i should have sent the threat letter next but it all ends the same way so no drama.

    Ps, i thought exactly the same about 'Howard' in the new Halfax pantomine advert. Are our bank charges inflating his ego?
  • Don't know if anyone can help me or not. I'm having a bit of a nightmare getting the interest calculator to work for me. I can get the list of charges and interest on screen but can't get that into excel to edit. I know from my experience so far with HSBC that they want the description of the charge from the statement as well as the amount and date. I've had this delay with HSBC and don't want it to happen with Abbey too. Does anyone know of a formula I can put into an excel spreadsheet which will work out the 8% interest?
    So far:-

    HSBC £2515 incl int claimes, settled on £1998:j

    Abbey - £2995 claimed, offered £1098, accepted as part payment and proceed to next stage, response not satisfactory so currently with Ombudsman:confused:

    Cap 1 - settled on charge difference:j

    Barclaycard - settled on charge difference:j

    MBNA - 1 account settled in full, £993:beer:
    - 2nd account settled on difference:T

    HSBC Visa - no charges amazingly!!:rotfl:

    Household Bank Visa - settled on charge difference:T

    ACE catalogue - settled in full after 1 letter!!!:beer:
  • dalaw...Yes you should list each charge with a description and date it was taken.

    I understand where you are coming from and i assume you also believe some people will get their claim money back and then continue mis-managing their accounts and get charged all over again.

    I WAS one of the above and that is why i am here. With Martins advice i have turned around my financial situation and i estimate that with the successful claim payout i will clear my overdraft. Once this is done i have no intention to get back into that downward spiral of charges. I have changed accounts to an interest free one with A&L and i am applying for ISA's so that i can save rather than overspend. Alot of the threads are from honest decent people who have been vicitms of loan sharks and in some cases have lost everything due to the ruthless banks. This is our way on getting back on our feet and giving one in the B******s to the shylocks of the world.
