    Firstly your 'amount claimed' should not usually include any interest. That is up to the court to add on afterwards if you get that far. it is does include interest then don't worry about it - just be prepared to answer any questions about it.

    Secondly, as to what happens next - the ball is in the bank's court. the claim is deemed to be served six days after the court posts it out. From then the bank has 14 days to either file a defence or acknowledge your claim. They will almost certainly do the latter, saying they intend to defend it. That will have the effect of extending the time to respond from 14 days to 28 days (from the original service date).

    It is at this point that you should expect some contact from the bank - NatWest are good at getting their solicitors to send out complicated legal letters and there is advice elsewhere on how to deal with it.

    If the bank makes you a decent offer you should seriously consider accepting it in my own opinion, but it's up to you.

    In the unlikely event that the bank does not respond after either 14 or 28 days depending, you can apply for judgment in default, via the web site.

    Yes, just change the wording to saying you are claiming late payment fees and/or over limit fees.

    2. Can i still try and include the £12 charges?

    Yes you can try.

    3. Citi card let me pay half my balance and agreed to close my account. would i still be able to claim the ones from them?

    If what you are saying is that Citi wrote off some of your balance by closing your account I would expect they would want that money back.

    Any advice will be greatly appreciated.

    I sent the initial letter requesting alist of bank charges on 23/01. As I have not yet received them I contacted Lloyds who stated that I'd sent it to the wrong place (address located on Martin's list of bank adresses) but that the letter would make its way to the right location soon. They advised me to phone nearer the time; the last working day before the 40 days being next Friday.

    My query is..if I phone them next Friday, they will not have time in which to send me the list before the 40 days are up. Do I view this as Lloyds not complying in time and report them to the Information Commissioner? Also, do I go straight to making a claim online as all the other template letters are geared towards having already received the list of charges?

    Please help me if you have time because I am so unsure as to what I am supposed to be doing despite reading through each thread!

  • Hi, I have just had a date through for an allocation hearing and wondered if anyone might be able to give me some advice. I don't really understand the court process! The letter says:- "at the hearing the court will consider either: staying the claim pending the decision in a test case involving the defendant or
    giving directions for this claim to be heard as a test case and if necessary allocating the claim to the multi track for that purpose."
    Does anyone have any idea what any of this means?!:confused:

  • This is my first time of posting anything on the site so I hope I have done this correctly - if not then my apologies.

    I have a question relating to my son's accounts with Nationwide Building Society. He has two Flexaccounts, one of which he no longer uses. I sent out the initial letter to Nationwide on 30th January, requesting details of charges against him on both accounts, but as yet we have heard nothing.
    The account that my son is not using is currently £224.55 overdrawn, but all of that is due to charges. Foolishly, instead of paying up when he went 55p overdrawn, he left it and Nationwide have added charges each month. They wrote several times requesting reimbursement of the overdraft amount, and last week sent him a letter informing him that as from 5th March they were cancelling his overdraft facility on his other account. Today he has received a letter from them threatening legal action if the overdraft is not paid by 2nd March. Basically, I would like to know if anyone knows where he stands in this matter. Should he pay the overdraft now or should we inform Nationwide that he intends to claim back all his charges?

    You can't just go straight to claiming online without a list of charges you are claiming for. In fact neither can you send off the claim letters without a list of your charges.

    If he, or you I guess, can pay off the overdraft I would do that now and then carry on with the claim.

    Nationwide will more than likely close both accounts so make sure he has another account now and close the accounts once the overdraft is paid then ask for a cheque when you send off the first letter asking for the charges.

    and if you pay off the overdraft, make sure you get the money from his successful claim!
