To be honest.. I'm not 100% sure.. I wondered the same thing myself.
They are the only ones that have replied to me so far.. they said NO.. haha.
But.. they didn't say it was HP and I couldnt etc etc.. they just said they couldnt accept my offer and wanted the money.. now.
I was kind of guessing it was a kind of 'loan' .. But I still dont know. I will carry on the same with them until I hear otherwise.
I lurrrrrrrrve the sofa.. but if they DID take.. they so be it.. it's only a sofa (())
I have never seen DFS selling '2nd hand sofas' .. and (so far) .. I haven't read/heard of anyone having one taken back.
So I am going into this part a little blind actually.. haha.. But..like I said, they didnt say they couldnt.. just that they wouldnt accept.
:: fingers crossed ::
edited to add:
I just searched high and low..(google) and cant seem to find anything.. except I found this little snip .. on MSE actually.. :rotfl:
(it was about someone's sofa being messed up) but it said..
*Unless DFS have greatly changed their credit Agreement, it should say in big letters near the top - Fixed Sum Loan Agreement regulated by the Consumer Credit Act 1974*
so maybe thats what it is?
:rotfl: gawwd.. I dont know.
Hi Eupho
I also have a DFS sofa and have been making reduced payments to Hitachi Capital since last year. Will shortly be going on a DMP with CCCS. It is a loan and Hitachi Capital will do everything they can to try and recover it. The last I heard from them earlier this year was that they were going to take me to court but have heard nothing for months.
I hope that helps!0 -

Oo that does help! thankyou!
I already got the impression they were going to pull out all the stops.. Just by the fact they replied to my letter practically return post (and not a word from the other 12 (!!) yet) .. It was a 'Yeah whatever  about your circumstances.. pay up or ELSE'
kind of letter.:rolleyes:Very proud of trying to deal with my debts. LBM 04/09

:rotfl:Anyday now with some luck
hahah!
Honestly I was really disappointed not to have any 'decent post' from (any of) them today. (got a 'normal' monthly statement from RBOS )
I know this has to happen.. I know it may get bad.. but I just want to get on with it now. :wall:
Oh but I was reading earlier.. someone mentioned they used to work in some area/department like that. .. and sometimes it really IS because they just havent got around to reading your letter yet.
Thats why I'm tempted to TELL HSBC next time they call.. Stand my ground.. not be cajoled and panicked into anything.. and tell them in person too.

Hi (again) DG
I was just thinking for Sas..
have you actually spoken to anyone in person.. in YOUR bank.
My dad banks with HSBC.. he has a lot of properties and stuff.. (he is worried at my hooharr with them.) .. anyhooo.. He said that it depends (often) on WHO you ask. He is a pretty savvy businessman (unlike his daughter
:o)
It's worth a thought tho.. maybe you could talk to the manager in your OWN bank.. someone high up you actually work with?
Maybe you have done this already and I have just taught my granny to suck eggs..
evening
ta eupho for thinking of me.....:A
yes have spoken to my line manager (who is quite high up) basically as the 'loans/ collections / financial guidance depts are literally a seperate dept from the area i work in - i have to go through them for everything. If your not a 'Premier' customer then basically have to go through the call centres. she was great and has said she will speak to 'people' if ness - but was reading our policy earlier & basically if staff do MLA's - the max term they can get is 7 yrs.
This all changed about 5 yrs ago when the fsa were pulled about over lending - 10 yrs ago when i worked in a branch - all loans - personal / managed / debt collections were handled in branch - i used to do them!!
so spent an hour with my wonderful bank on the phone tonight - going over it all again - i know the MLA is more debt but its the only route for me at this time. on paper it works - we will have £160 per week to live on - surely thats enuff for 2 people - no kids????
now have to hope & pray our other creditors accept - but as you point out - if it went to court then surely the prospect of me losing my job & not being able to pay ANYONE is the woest scenario!!??
oh - & at this stage the bank could still refuse me a MLA! if they do - i will revert back to cccs - default on all payments to the bank & get cccs to offer a much lower sum & probably get signed off work with stress/depression (am already on tablets) so that way the bank can't disipline me if i'm signed off.
god - i am sooooooooo fed up with all this. want one eve without a headache & to have at least an hour when i'm not thinking about how much debt we're in!!!
another ramble....................pologies.........................:o

Hi! I only have Halifax from your list but I many other different creditors too!(I'm also doing a self managed DMP)
It really does seem to be different strokes for different folks, as I know others have had a really hard time with them, but they have (so far) been brilliant with me and my OH. They accepted pretty soon after I sent the first letter and said they would reduce interest to 6% for the first 3 months, although they haven't actually charged either of us any interest. They also stated that if our circumstances hadn't improved after 3 months (which are nearly up) they would stop all interest and charges and agree a long term plan without defaulting us. I'm about to start negotiating with them again so I'll let you know if they keep to their word
