The email went on to say a replacement would be depatched.After a couple of weeks there was still no sign of the screen so I phoned the company uk helpline - they where very helpful and told me that they would ensure the item was despatched as there had been a delay but it shuld be out in the next day or two.


    Sure enough i received a parcel last week - another new projector. Not a screen(wich is what i sent back faulty) but a complete new projector.

    The projector itself is worth approx £450 and the screen I could buy for less than £100.

    Dilema.....do i return the projector and complain it was a screen I wanted or do i shut up and smile nicely in the knowledge their loss is my gain!.


    So - the question is.... What should I do? and indeed what legally should I do? :confused:

    You could be in trouble if the company realised their mistake, but whether they would pursue you from France is debatable.

    You could write to them and point out their mistake. Tell them you want them to arrange to deliver the screen and collect the projector at the same time (this way you know you've got it! ) Also tell them that you expect them to pay all costs and to refund your postage losses to date.

  • I bought a HI FI in December 04 from Powerhouse. It has developed a fault where the CD skips all of the time. Can I take it back to Powerhouse for free repair or replacement.

    I think you'll find that Powerhouse went out of business. Contact the manufacturer and they may be willing to help but I doubt if they will do it free of charge.

    Also if you have to return the unit to the manufacturer think of the hassle of posting it back to them and the cost involved. Maybe simpler to get a repair locally.

    After reading the guide, I understand that restaurants don't have to supply free tap water to the public but do they have to supply it free to customers who are eating in the restaurant?

    The restaurant pays for the water through its water meter so some will feel it right to pass the cost on to the customer. Also some restaurants will charge for the service in providing the water.

  • thanks for that, art. I thought they had to provide it... heard it somewhere or other.

    i still think it's ridiculous, not serving tap water! i've noticed the all-you-can-eat chinese buffet restaurants do this, because they make the profit on extortionate drinks, while making little or no profit on food. they attract you in with the food prices, then sting you with the drink prices.

    so what about cinemas?
    i saw a sign at my local uci saying they would eject anyone caught eating hot food from other premises (ie the mcdonald's next door) so can they do this? after all, they sell hot food in the form of hot dogs, which you can eat in the cinema, so why (if even) can they eject you?

    Hi.can someone please help me?
    I bought 2 sofas from our local sofa and pine company,they were delivered31/5/2005.
    I then decided to have a matching chair aswell this was delivered in august 05.
    One of the sofas and the single chair have a fault,the right arm/side is coming loose.
    I reported this on 9/12/05 and they sent someone out to look at it on the 11/1/06.
    He agreed it was faulty said it could be repaired but in his personal opinion he would not accept a repair on a sofa only 6 months old.
    He sent off his report saying i wanted both the chair and the sofa replaced in the same fabric to match the sofa that was ok.
    I phoned in feb because they had not been in touch they told me they wanted to repair, i told them again i would not accept a repair so they agreed to replace both if i sent off a swatch.
    They got the swatch 15/ feb i rang yesterday to see if it was ready yet and have been told that they no longer have the same material.
    They now want me to pick a new material i do not want to do this i have had my room redecorated new carpets ect to match.
    I have asked for a full refund on all 3 items £1350ish they now tell me that they buy the sofas from the manufacture buyont who are only willing to replace not refund .
    I bought from the shop am i entitelled to a refund from them ,also she said even if they did refund they would not refund the sofa that is ok because there is nothing wrong with it.
    It was bought on the same order as the other sofa they were £500 each.
    She is ringing me today so if anyone has any advise where i stand i would be very very grateful
    This has been going on for nearly 4 months now we bought from these people because they were so helpful and we thought it was there own shop ,they are husband and wife and said any problems just ring,then the first time i had to ring they tell me not there problem its buyonts.

    Make sure you spell out your demand very clearly to the retailer and confirm in writing. When they contact you re-emphasis this and tell them that if you don't have your money back within 7 days you will go to Trading Standards.

    If the matter isn't resolved in 7 days contact your local Trading Standards Department and ask them to help you.
    Ask them if you should go straight to the Small Claims Court to get your money back.

    It is important that you keep records of all dealings with the retailer as this will help your case.

    Your contract is with the retailer. Don't let them try and pass you to anyone else. By what you say I think you are entitled to a full refund. If they phone you today tell them that you are rejecting the goods under the Sale of Goods Act as they are not fit for the purpose.

    Don't let this drag on too long. If you don't act quickly you may play into the retailer's hands. Stick to the 7 days and then take action with Trading Standards.
