Morning (well afternoon by the time I've finished:D )
I have been posting on the main board and on one or two other threads, and I'm got a bit lost about what I've written where, so I thought I'd come "home" and update you all in case you haven't seen my other posts (I don;t think I have posted this stuff on this thread, but apologies if I am getting repetitive )
So,
Northern Rock called me yesterday. Spoke to a pleasent enough chap who could see my point and has suggested something called a Tomlin Order as an alternative to a CCJ/Charging Order. Don't have the full details of this yet, but from what I've gathered so far, it is a kind of Consent Order whereby we agree a monthly payment and so long as I don't default they will leave me alone. If I do default then they can go straight for summary judgement without needing to re-issue papers etc. Don't know about interest at the moment but will post mor e when I do know. Seems like a reasonable outcome at the moment tho.
Also my dad has offered me some money to negotiate F&F settlements with all creditors, although I won't be offering any to NR :rolleyes: . The most this would amount to is 30%, but as I now can't keep up my DMP as I'm not working, they may consider this after a couple of months of getting £1.00. I'm still hoping to do childminding but it will take 2-3 months to get registered which is a bit of a pain as will miss school hols but never mind, and obvioulsy it will be a little while for I earn anything. Am registered for temping but nothing is coming up.
So that's me for now.

It will effect him yes as you are financially collected and it will definately effect any future mortgage deals.
They can't ask for equity out the house I believe that is an IVA thing. But if they don't accept your DMP they could go for a CCJ (this is worst case scenario so don't panic!) and then go for a charging order which would mean that if you sold or refinanced your house they would want there bit paying.
You really should think about telling him, I know its easier said that done but he could take it worse the longer he is in the dark.

What does that mean, i am financially collected? do you mean connected...How does that affect him...Doesnt he have his own credit rating? do you mean when we go to remortgage?...I have heard alot of people on the board say that you can still get a half decent deal even on a DMP???
I thought that unless they try and do a charging order thingy on the house that we have a mortgage on together he will never have to know about my DMP as its on my personal unsecured???

Doh! Sorry was writing a letter at the same time I did in fact mean connected!
He does have his own credit rating but it will be affected to a certain degree by you. So he may have no problem getting another card with just him but a new mortgage could be harder.
YOu still can get an OK ish deal but do you want to be in that mortgage room with an advisor when your husband finds out why he can't get a mainstream deal and how will you both feel if the truth came out then?
It is your personal unsecured debt and your choice but its a biggie keeping it a secret and how would he feel if he found out just before you went to court or like above when you next apply for a mortgage.
Its definately worth some consideration telling him, is there a big reason you don't want him to know?0 -
Hi All - Having a bad week or two and just need a jolly! I was pleased as punch to speak to my contact at the CCCS who has said it looks like we can go on a dmp from maybe september (currently paying £1 token payments to 12 creditors, owing (before all the charges were put on) £25500).
Our initial dmp payments would be £100-£150, but they are just initial as my income is growing monthly so the extra I put away for three months to make sure we can live without it and then will ring CCCS to up the payments.
CCCS have been great and in truth our creditors havent been TOO bad recently, Im just feeling really down about things, mainly because I know that since March I owe nearly £1000 more than i did to start with, in bloody charges.
Can anyone tell me - can I claim back charges from companies Im in a dmp with? Would they cancel their agreement to the dmp? At the moment I'm paying one £1 and being charged £22.50 everytime they send a letter (fortnightly if not wkly (ANDa late payment fee for missing their minimum payment!). Its heartbreaking!

I would definately try to claim back charges but wait until you have had all those added you possibly can and interest is frozen. To me all claiming back charges shows is that you are desperate to owe as little as possible.
I claimed my Lloyds bank account ones back not via the official template letter route but through a complaint and that forced there hands to accept the DMP.0 -

I know how you feel. At the moment I'm taking one step forwards, 2 steps back. I just wanted to let you know that with one of my creditors, I claimed back charges at the same time as entering a DMP and they have refunded the charges and have accepted my lower payments, stopped interest etc. I don't think there's any hard and fast rule. Maybe a good idea to get the DMP in place 1st then claim back the charges as you will then know how much in total to claim for.

ive opened an Alliance and Leicester account and have transferred most of my direct debits to this account from Lloyds and plan to use as my main source of banking - however on of my creditors is MBNA on an AOL credit card with an outstanding balance of £4500 - ive now see that MBNA run Alliance and Leicester credit cards - could they plunder Alliance and Leicester current account even though i dont have and A&L credit card?? im sure they are not on the linked accounts list??

Just having a blue day I think - Im glad we had the lightbulb moment, gladwe've reduced our outgoings so dramatically, glad we are surving on the lowest amount CCCS would let us budget for food/expenses etc and am usually very cheerful about finding the bargains etc, creative cooking - just guess every so often it still hits how much in debt we are.
now must stop feeling sorry for myself and go do menu plan for next week so I can do my shopping in the morning.MSE-ing since 20070 -

Quick update ...... First payment to Payplan now made YIPEE:T
Hopefully now they can send the SOA to all my creditors as I am sick of getting calls from Goldfish abou this!
In total arround 40 calls from them - can you beleive it! I spoke to them about 4 days ago (for about the 10th time) after 8 calls in 4 hours and said , calling every hour is not going to magically change my siutation and I was very assertive (not rude though) amazingly it worked and no more calls from them!
Just a little story to make you smile......I pay my BT bill (phone / internet) by DD each month, therefore my BT phone bill is paid in advance and in credit. My quarterly bill has just come through and because the payments I had made (based on what BT had requested) meant the BT balance was £41 in debit. Instead of emailing me / changing my payments / writing to me (you would think that would be sensible) They stopped by boardband service with no warning ! Wait for it......the message to say it had been stopped because my account was not up to date was yes you guessed it, posted on my bt account ON LINE !!!!!! This was only discovered after about 3 hours on the phone to the helpdesk to see why my internet connection was down.
I can not do without the connection as I have a small ebay business on line and that is how I earn extra pennies, so I had to pay the extra £41 there and then, it still took them 3 days to re connect me!
I am not paying the DD in advance anymore, they can wait for every penny from me!!!!
Sorry, bit long winded but thought this just about highlights the type or organisations we battle with on a daily basis, as if things are'nt tough engough!!
Anyway, not around for a week or so, going on hols (paid before the DMP). Good luck to everyone and I will be in touch when I get back
