I'm with CCCS so can't help re Payplan.
I wouldn't bother claiming back charges until they have stopped charging them or you'll end up having to do it all over again. Just keep sending them letter asking them to stop charging etc for the time being.
How far can i claim back charges?
2 of my creditors, Welcome finance and citi, both loans, whacked the entire loan term interest on straight away, can i claim any of this back? Its thousands???
Can i get the interst on my other loans frozen or is it just credit cards???

You can request all interest on unsecured loans and credit cards be stopped. They have't got to though. They are within their rights to continue charging.
You can claim back charges back 6 years. The £11.67 isn't one of your payments to a creditor is it? Last month one of my payments was rejected by a creditor, and ended up back in my account as a payment, if that makes sense? It could be that the £300 hasn't quite reached PP yet?DMP mutual support thread No: 2430 -
Hi All,
I'm really fretting at the moment about the long-term feasibility of my DMP. At the moment it will take 23 years to complete, which is not acceptable to creditors or us (our mortgage is I/O so we need to start paying that before we die!!!)
It is very early days - DMP started Sep-08 - but I'm trying to think of ways to increase payments. Next September our DD starts school, so we won't have to pay nursery. However I now know that there are no breakfast or afterschool clubs in the local schools, so we're faced with on-going childcare costs. I was hoping to throw the full £400 at the DMP, which would bring it under 10 years. Now it's not going to be anywhere near that.
I'm thinking about stopping my pension payments and using that money? At the moment my company contrinute 3% of my annual salary, so long as I contribute 3%. I currently contribute 7%, which equates to a net salary drop of around £100 per month. I could put all of this towards the DMP, but would loose out on my companies contribution.
What do you all think???????????????? Also, does anyone have any suggestions re. school run / pick up when both parents work fill time over 45 minutes away???

I'm not a parent, so I can't advise on the school run thing I'm afraid (except, do any other kids live near you so you can share the run with another parent and only do half each?)
I have the same thing at work with pension and pay £150 a month into it, with my firm paying about £180. I've been advised by the CAB that creditors are unlikely to accept a DMP offer if they see me putting that kind of money into a pension scheme and have advised me to stop my payments for a while. So I have. It doesn't need to be for long, but it will show your creditors you are serious about trying to pay them and will probably take a few years off your DMP as well!DMP Mutual Support Thread member 244

OH received a letter today from Moorcroft Debt Recovery Ltd (pre court division in bright red letters!)
It reads -
Dear OH
We have been instructed by Halifax to collect your overdue debt of £xxx
It is a legal requirement to send a notice of intended litigation before legal proceedings in the County Court are issued. This letter fulfils the requirements even it is not read by you.
To preven legal action from being taken it is essential that you settle this debt without delay. Payment should be submitted in full within 7 days or contact made to this office immediately by telephone on xxxxx or by letter within with your payment offer. Failure to contact us by 10.00am on 28/10/2008 may result in legal proceedings being issued against you without further notice.
We would draw to your attention that if Judgement and an order for repayment in full is obtained and remains unpaid enforcement of debt may be sought by one or more of the following
1 Warrant of execution of baliffs against goods owned
2 Application of attachment of earnings order with your present or future employer
3 Application for a charging order on any property you may own or purchasin under a mortgage
We would emphasise that should judgement be enetered against you this may affect any future credit application you may make elsewhere. We would also draw to your attention that all legal costs are usually payable by the debtor.
All payments must be made payable to Moorcroft Debt Recovery Ltd and forwarded with this letter to the above address.

So what is our next step? This is for OH loan from Halifax, we are now on a joint DMP with CCCS. Shall I write for a CCA from Moorcroft? Shall I instruct CCCS to pay this company instead of Halifax?
I know the letter contains alot of 'may' and 'if's' but I have checked out Moorcroft and they don't appear to be one of the easiest of DCA's to deal with.
Any advice on what our next step should be please?

I've just caught the other thread about pension payments.... seems were all thinking the same thoughts tonight. I wish my company contributed that much!! I've just PM's CCCS_Sarah to ask same question. I think this is the necessary choice right now though. I'm 30 and have been paying for the last 10 years, so there's some money built up - not much, but it can sit there and hopefully build, while I can work on reducing the debt.
There's no other parents with young kids in the area, but I think I'm going to share the task out among myself, my husband, my dad, my aunt and someone else. One person per day of the week responsible for the school run?? Our employers should be able to cope with that? And my mum is teacher training, so she can help during holiday time.
It's just that the saving on childcare, if I can use all of it, could be the life-line to financial freedom. It will still take years, but we've got to start paying our mortgage in 10 years time, or we'll be paying it beyond retirement! We're both nearly 30 btw.
Oh yeah, and work damn hard and try to increase our earning bracket!!!
I'm just feeling so despondent right now. I think there's an element of winter blues here as well

Hi Toffee, that does sound unnerving for sure but as you say contains the usual "if's and maybe's" etc so maybe just empty threats at this stage. I can't really advise about that particular company, maybe contact CCCS and see what they say. I think all you can do is what you're already doing, they can't have what you have'nt got after all.
These companies make me laugh, as if threatening you like this is going to make you suddenly say go on then I'll pay the full amount just like that!DMP Support Thread Member 238DMP started October 20080 -

Don't be desperate, you should be proud of dealing with your debts, I think in your case leaving your pension where it is and letting it build up is definately the right choice. You never know whats round the corner you know and loads could change in future to help you pay off your debts quicker.
