    Well, I'm 2 months in and most of the creditors have accepted the CCCS offer with the notable exception of Lloyds TSB.

    Seem to be in a bit of a catch 22 with them.

    I am reclaiming bank charges from them but they refuse to deal with my case as a priority, and have told me to downgrade my account to one that does not have monthly fees. I am quite happy to do this, but... you can't do it online or on the phone you have to visit the branch in person. Went to a branch on Saturday but was told I have to go to my own branch. My own branch doesn't open Saturdays and I work full time in a different town, so am now in the daft position of having to transfer an account from one branch to another, just so I can change it to a basic acccount, and the new branch can refuse to accept it.

    The alternative apparently is to close the account, but they won't do that until I clear the overdraft...which is included in my DMP.. which they will not accept payments on because they are not reducing the debt by enough because of the fees on the account I've got.... and I can't change the account....!

    Bit of a pattern here:confused:

    Any one else come across this or have I just dealt with unusually stroppy staff?

My biggest problem is that i know Amex DCA are taking me to court as they will not do repayments at all and are threatening to get a charge on the house and/or make me bankrupt.     with the amex dca - not one of mine so dont know who they are, is this for a credit card account?

    if so have you requested a copy of the credit card agreement worth doing so for a £1.00 and also remember its your legal right to view the conditions and information you signed so many years ago

    whilst i want to clear my debts im also looking at the legal implications of all the threats that have been thrown at me for the past 6 months so im making sure what the companies are threatening me with is valid, legal and correct.

    Ive fought for my home this year and when you face that then anything else is just another battle to be faced,

    if you need any help with any letters pls shout or pm and i can get a copy to you

    my attitude is be a bit ahead of them and know your rights then you can make informed choices for what is right for you and your family.

    Even if you get to court at the moment you will get the opportunity to show the judge your income and expenditure and if you can only afford x amount then the judge will not force you to pay more and anyway why should they amex get priorty on your house above other creditors ( i went with my friend and boy have link financial backed off when we shared this truth with the judge)

    Also so what you get a ccj , until you fault on the payments req by the judge on the ccj they cannot go for a full charging order, So are you paying them anything at the moment, does not matter if they say its not enough - pay them the amount as per your budget and then we can deal with the court action at the time dont worry, im no expert yet but learning all the time and we just need to get consumer savvy and work within the legal constraints and proceedures.

    Dont be despondent pls, i was early part of the year but now im fighting for my life and my family and home.

    read around the forum as much as you can, and you will learn - im going to see trading standards this week to show them the supposed credit card agreements ive been sent which are hard to read, half the info is missing and they expect to take me to court with this rubbish?? well i will only get there kicking and fighting but thats for another day ;)

    keep the faith and learn fast is all i can add

    Hey Symesd good news about the PPI cheque lets hope its a good omen.

    Good luck with the MOT, ours is due in a couple of weeks, dont think its going to pass, not got a good feeling oh oooh!:eek:
    Tax also due at end of this month, almost tempting to get rid of the thing only OH needs it for his work, oh well

    Really helps to hear what you've said and of course you're right about being ahead of them. I'll do some investigating.

    Amex are a credit card and according to cccs they are very aggressive, threatening repossession, charges and bankruptcy, but i'm going to fire off my dmp letter with a para about their fees costing more than my debt eventually and since we've been trying to sell the house for a year, how do they think they'll get money that much quicker...

    Have been listening to news today and judges are being instructed by the government to offer lots of options before repossessions, bankruptcy etc, like offering deferred payments etc.

    Hi all
    I have loads of bank charges to reclaim which would all but wipe of my debts to the bank but I wondered whether it would be better to wait my DMP has been up and running for a while before I set the ball in motion?
    I know it's all on hold at the moment anyay but is it best to get my claim in now?
    How will this affect the way my bank act towards the DMP, they have already agreed to accept it by the way.

    Help.I have posted on the CCCS advice thread, but I need a reply. I am waiting to start a DMP with payplan,all the paperwork done,but I can't seem to open a basic account due to a shot credit rating. Just tried open a co-op cashminder account - referred to under writers. I have no ccjs, not over overdraft limit, no arrears, just too much credit! What can i do, I cant delay much longer or my bank will realise I cant pay any more and off set my wages, then I am stuck.
    unsecured Debts at [strike]August 2007 £79,984[/strike] September £79,579 [STRIKE]Snowballing date July 2013[/STRIKE].

    May 2009, £76,772 unsecured debts

    DMP started Dec 2008, End date at start 2133!

    The only bank I haven't overdrafted with is NatWest so I went online and sent application form in, but still waiting to hear. Have you tried all the main backs (that you don't owe to) online? Lloyds is an online application.

    What about building societies? Nationwide? That'll be my first choice if Coop falls flat. A passbook account could do for now until you can get sorted with something with an Extron card?

    Do the Post Office have a basic account? Or do they just operate the Coop accounts? You could check online.

    I'll have a look through some of threads. Why not try the CAG site?

    Oh its horrible isnt it. I thought opening a new account would be easy, but the problem is so many banks trade under different names I am not sure which ones are with who?!? You know Loulou I have a very responsible well paid job and two houses (wish I couldsell one or both,but hey I cant right now)it is embarassing. I stillneed to ableto bank online,I just dont have time during the week for any other method of banking. I suppose i will just have to wait and see what they say,but if they say no, tme is running out for my wage account changes. If you apply for more accounts, all those credit checks adversely affect your rating further.

    I'm in a similar boat. My husband is a property developer who has been trying to refinance a house we own and rent out to release cash which will clear all my debts but not one bank will give us finance because we're in arrears with out mortgage. The problem is that I've had so much grief with credit cards ringing that I relented and gave money to them first and left the mortgage for him to pay, which obviously didn't happen. If I knew then what I know now I'd have told all the cards to get stuffed and paid the mortgage first - they just haven't chased us at all though...

    I really needed an account with a cheque book - I have never been without one - I'm self employed and some suppliers prefer a cheque - I never thought I'd be worrying about not even having an electron card...

    I claimed back £12k in bank charges 18 months ago, I used most of them to pay off cards. I feel so angry with myself now. My car is due to go for a overdue service tomorrow, but this is the first time I've had to ring and cancel and explain that I can't afford it yet.

    So depressing, but reassuring to know that there are thousands out there like me, and the ones on this thread are amazing.
