  • Afternoon all, going to update my little diary in a min but thought I'd post here as well to ask a few teeny tiny questions! Just had my 1st appt wth CCCS. I start my DMP 1st Nov. There going to send a form out to sign and return and send back with wage slips etc. How soon will i get this? Then he said once they receive that i'll get my welcome pack and a giro slip to make 1st payment in nov via post office. Does the welcome pack come quickly as well? Lol just eager eager to get it up and running. And was going to ask summat else but its slipped my mind now:rotfl: too much going round my head at the mo! I'll come back when thought of it, off to create my signature woopee doo!!!!

  • Hmmm, kind of the same question....

I've just filled in the Debt Remedy on CCCSs website and they advised a DMP, I knew this as I'd been that far already, but do you know what I can expect next?

well done you have crossed the first hurdle - please believe me you will feel very empowered by your decision and wont regret it!!

anyway back to your question - you should receive your form ( im sure this just gives them the authority to act on your behalf) very quickly and as soon as they receive it back you will get you welcome pack - if you cannot wait for your welcome pack i thnk they will email it to you if you ask

hope this helps and good luck!!!
  • Aw thankyou louietudor. Must admit feeling better about it all!

  • Grrrr, you start to make headway in one direction then something pulls you back with a bang.

Am currently looking at 19 years on my DMP to pay it all off. Apparently your lucky to get anywhere near 10 years in which to pay it all. Gutted. Anyway, have learnt today that I may have a possible change in circumstances, not for the better. May have to reduce my hours by 2 - 3 hours per week at work or pay very hefty childcare bills. I can afford to do neither. I would lose my job if I went bankrupt and also my home (which is not owned - private rented).

Also learnt today that Lloyds have accepted all 3 plans I needed them to albeit for 6 months. On O/D they have frozen all charges and interest. Loan still adding interest but accept on plan. Credit card, first to stop charges and reduce interest. Two other creditors accepted straightaway both for 6 months and two I have not heard from but they will shortly both be receiving their second payments for CCCS, so hoping that is good news.

Was feeling so much happier when I started plan, actually can see I can afford to eat and get about unlike before. It took such a huge strain off of me. I know every 6 months creditors want to see your payments to them rise when they re-jig plan, I knew next year was going to be a bit tough as circumstances were going to change in credits awarded etc, less than now, which is what my current plan was based on but now with the possibility of a small reduction in hours, not good at all. I can't work anywhere else or make the money up, work practically full time as it is with two young kids, which is where I went wrong, working to many hours in the first place. Feel really fed up now. All my positivity has gone. :-(

Thanks :) I'll wait for the bits to sign and get them sent straight back then :) Hope my debtors will accept reduced payments

Is it likely that any of them may try to take me to court?

Thanks again to all who advised me yesterday. Dp sat and wrote a letter to BOS last night (from me) after he found all the legislation stuff online, and basically said they were breaking the law by not allowing me access to money which were from CHB and tax credits. It is quite strongly worded and hopefully they will reply (and give me the money back!!). They have £495 (there was already £200 when they froze account) so hope to get all that back, then xmas is sorted lol. Fingers crossed people!!:D

It's a while since I posted but I have been busy.

I have sent CCA requests to 3 of my creditors and to date, no-one has been able to supply one. So I have instructed the CCCS to withhold payment to these creditors as the account is in dispute.

Now, whatever your moral stance is on withholding payment for non production of a CCA, I do not wish to avoid paying this debt but I do want to be in a position to offer a fairly low full and final settlement figure.

Since the death of my husband in June, things have been tough and I still have this debt hanging over me. Believe me, creditors are not interested in your personal circumstances no matter what their "caring" blurb may say.
DH left no money but that does not stop his creditors writing and asking for all kinds of information to which I have no answer.

His debts died with him but you try proving it.

    hiya janey

im so very sorry to hear of this still even after your husband passed away you are still having to deal with such debts

so were the debts only his sole name? or were some or all in joint,

im confused if only sole name why are they still chasing you? can they legally from his estate then? im unsure if they can

ive just reread your post, i understand now you have requested the cca for 3 of your own debts so they have not responded within 12+2 days, they are in default.

im also on the consumeractiongroup forum and there is a lot of stuff on the cca and the legal information. Remember it is our right to a copy of the cca, so good on you requesting it and if they are in default , the accounts are now in dispute - as im doing my own dmp, im still awaiting on my cca too

however, have you had confirmation from cccs they will actually withhold the payment? i would ask for confirmation of this

anyway i do hope you get something resolved if you need further help just shout ciao for now maz

at_my_wittsend - There's no obligation to increase payments after six months, you can just tell them that your situation hasn't changed. We haven't increased for the last year because everything has gone up so much.

Re: benefits - as far as I know, it's not applicable to all benefits so please make sure before persuing this an an option. I know it applies to Income Support, Incapacity Benefit and Job Seekers Allowance (although I'm not sure about contribution base). But I don't think that it applies to Tax Credits and I'm pretty sure it does not apply to Child Benefit or Disability Living Allowance (as these aren't means tested).

    Hi everyone

I am a new DMPer - started mine this month.

Just a quick question about my overdraft. It's with Lloyds TSB and I have put it on my DMP. They were reducing it at a rate of £50 per month before I went on the DMP.

They were offered more than this in my plan (nearly £80). I haven't heard anything from them and they are still adding charges to my account and have reduced the overdraft by £50 as usual. Therefore, this has put me well over my overdraft limit and will obviously cause me to be charged more next month.

My question is do they just keep on piling on the charges? I don't use the account anymore and have no money going in there (apart from my DMP payment) and nothing coming out. Will they eventually default me and then sell the debt on?

They keep on calling me and asking me to ring them back but I am fed up with telling them that I am on a DMP. They just don't listen. Should I just keep things as they are and wait for them to default me and close the account and sell it on?

    Emily x
