Stupid question time about PPI, charges and CCAa's!
If I ask for a CCA does the creditor assume I don't want to pay?
I am not disputing any debt, I have spent the money and had the goods but I would like to see the original CCA's from all our creditors just to see if ppi box was ticked especially for credit cards, is this the best way to put a claim in about it being mis-sold etc?
I have been contacted by a DCA, should I ask them for a CCA too?
I have been sent a letter from a company I don't recognise for Great Universal. They are threatening me with a door step collector (is that one of them black scary floaty things from Harry Potter? :rotfl: ) Should I ask these types of companies to provide a CCA before any correspondence? I understand some of these are in-house debtors but some creditors are sending letters from 3 different addresses!! A tad bit confusing at the minute!
What's the best way to claim back charges?
Being charged £12 extra classed as late payment, administration and over the limit fees every month. Sometimes being charged for two out of three of these every month. How can I ask for this money back if it is classed unfair?
Default notices
When you receive one of these does it mean the debt has passed on to a DCA? The reason I ask is I'm sure I'm receiving standard letters several from different places and monthly statements as usual.
I have found some template letters from the National Debtline but just wondered what to do first; ask for CCA's, stop interest or ask for charges? I am not looking to dispute the debts, we owe what we owe but if I can claim back any of the la-la amounts of interest, charges, ppi we have paid, it would help immensely in our situation. Sorry for all the questions but I have messed around on the internet for weeks looking for the answers but I get baffled by the jargon sometimes.

Hi Maz
The debt is in my sole name and the income that I have and have submitted to MBNA is in my sole name as well. I am offering them a payment on a pro rota payment. I know that it is very early days and I know that I am going to get all sorts of letters and phone calls but we will have to see if MBNA phone me back at all.
If you could dig out the letters that could help I would be grateful
Thanks for the help

Thanks for the welcome guys. Reading other people's posts on here has made me feel so much less of a loser for having to resort to a DMP!!!!
My CCCS paperwork arrived this morning (I completed the whole thing online and haven't spoken to anyone yet). I also received my new debit card and account details for my new Lloyds account. I will ask HR to change my salary account on Monday so no more money goes into my current account with the overdraft... Then I just have to switch all my direct debits. I presume I should do all this myself, and not use the forms for my new bank to do it for me? I need to know it will all happen ASAP and nobody will try and take direct debits from my old account!!
I'll collect together all my credit card statements as they come in this month and send them off to CSSS all together.
One thing I'm stuck on is what to write in the "reason for change of circumstances" bit of the CSSS form. My reason sounds so long-winded and pathetic...
My partner is schizophrenic and has increasingly become less stable and able to continue working. His employment and NI history is erratic and insufficient to be eligible for benefits. I have tried to manage and very stupidly not acknowledged his decreasing contribution to household bills. Basically I have now taken my head out of the sand and realise I can no longer manage the bills AND debt repayments alone and have to dramatically adjust our lifestyle and expenses to be within my sole salary, without using credit anymore. The pressure of having to earn is just making life unbearable for my poor partner. And him having more and more episodes of erratic behaviour is obviously pretty hard for me to deal with too....
I also don't know if I should mention that we expected a £21k compensation payment for a personal injury award to my partner, which we fully planned to use against debts (and why we weren't too worried about running up the cards because we thought we had this coming to pay them off!!) but the defendant has gone bankrupt and we're advised by solicitors it is very unlikely the payment will ever be received. Maybe I should phone CSSS and see what they recommend I put on the form.
Right now I just want to fast forward 2 months and for all this to be in place and started!!! I'm planning on sending the CSSS creditors letters out at the end of October, with token payments to each creditor of roughly what I think CSSS will send them. Then I will send all the paperwork to CSSS and arrange a standing order to them in time for a 1 December start....
It might actually be a merry Christmas after all this year (a quiet one, without pressies, but with food on the table and no stress or panic of massive bills in January!!!!)DMP Mutual Support Thread member 244

Just started my DMP with CCCS, first payment sent Oct 1st.
I may be speaking too soon, but....my phone hasn't rung from a creditor for TWO WHOLE DAYS!!!!:rotfl: :rotfl:
The phone calls peaked early on, luckily mostly when I was out but started 8am and last one always just before 9pm! As the message trickled through about the DMP, some creditors stopped calling but Citibank continued (first letter from them received Oct 9th, still no acknowledgement of the DMP!). My phone line went down for a few days the week before last and I hoped that would put them off, but no, as soon as I was back on air there they were again. Their last call was on Thursday. Maybe their diabolical dialler machine thingy has gone up in smoke
And all before they have received a penny from CCCS!
And I didn't answer a single call...
The postman will probably bring me some nice letters instead, then..
But maybe there is life after unrelenting phone calls....:o

Hi Skint,
Most folks recommend you send token payments of £1, so that you can save as much as possible for an emergency fund before you start the DMP. Also, I think if you estimate what CCCS will pay and you pay a creditor more than is offered in the DMP, they might expect the same amount every month! Better to keep some back for yourself in preparation for life without credit!
Good luck, things will get better and the stress will ease up once you get started.

Good point Rabbit!! I hadn't thought of that... they won't be happy if the payments go down even further from CSSS....!!DMP Mutual Support Thread member 244

Had an interesting conversation with a woman from MBNA yesterday. She called to advise me that my 2 MBNA accounts, on which I owe approx £5,000 and £7,500, have been accepted on their "Serious Financial Crisis Plan". This means that they will stop any interest and charges, and I must continue to make payments via CCCS (around £35-40 a month between the both), but my accounts will continue to fall into arrears and this plan will only last for another 5 months.
After 5 months, if I can't up my payments, then the account will be defaulted and sold to a DCA.
She explained that their "Debt Repayment Plan" required that the minimum monthly payment would clear the debt in under 10 years (i.e. Total Debt / 120 = Min Monthly Payment). So, if my situation did change in the next 5 months and I was able to increase my payments to this level, then they can restructure the debt to show it was on a payment plan, no interest or charges would be added and the account would not be defaulted.
Now, as it is early days in my DMP, and as I don't see my situation changing in the next 5 months, I expect the account to be defaulted and sold. It would mean me more than doubling my payments. But I still found it interesting to know what their current policy was.
Although I have just been reading the MBNA thread on this board this morning, so am wondering whether they might make us a F&F offer before selling the debt on? Don't know where the cash would come from though...
MM
When you mentioned the 10 year thing that actually made the letter I received a bit clearer. They had written to me to say they had restructured my debt, wiped off the arrears and stated that the debt would show as up to date on my credit file and this could only be done once and I need to maintain my payments via CCCS. I'm going to assume they have done this (rather then send me the version you received) because my debt will be cleared in under 10 years based on the repayments. Considering the recent posts about them I wonder if they are doing some sort of exercise atm0 -
I just don't know what to do, it was all going so well. We had changed bank accounts and we're in the process of getting all that sorted out. DP rang Tax Credits lot on 26th Sept to change accounts etc, they asked if we wanted the info passed on to CHB lot, so he said yes as it would save us a phone call.
Well, CHB (£175) was due in this morning and when I went to check the new account, not there so I checked the old (frozen) account, there it is! I rand Tax Credit people first who said that they passed info on on the date DP rang, so I rang CHB who said they hadn't received anything about new accounts. All they could suggest was that I contact my old bank, cos they're really gonna give me it back aren't they?!
It's well and truly screwed us up for the rest of the month, it's going to leave us unable to pay things this week and we'll be playing catch up for the next few weeks. How am I going to be able to make my CCCS payment now? We're just as skint as we were before DMP and quite frankly, I could sit down and cry.Starting DMP with CCCS 1st October 2008
