  • Have you contacted your old bank - surely they can't keep money that is meant for your kids? :confused: It must be worth a try - demand to speak to a supervisor if the person you're speaking to is no use - they have more authority. Tell them you're trying to sort out your debts if you have to, just don't give up until they give in!

  • Thank you both so much, Symsed and Rabbit! I wondered about the bank being able to keep Tax Credits and CHB a couple of weeks ago but didn't find anything about about them not being able to keep the money (the Tax Credits paid £130 into the wrong account). I have sat and written the bank what is essentially a begging letter but think I might write something a bit more forceful now! I can't face going into the local branch as I hate them all and always end up coming out in tears!

    Hey all, hows everyone doing.
    Still all quiet with me, only had two Dmp acceptances as yet, Northern Rock and my bank RBS.
    Nothing from the others, no phone calls, no letters, no nothing. Feels a little weird actually like something's not happening that should be. Oh well no news is good news as they say.:D

    oooh you just wait til tomorrow your letter box will be stuffed with letters now :rotfl:

    I received a statement from Next over the weekend asking for stupid amount of pounds and then received a letter today saying to continue with my arranged DMP payments :rolleyes:

    I'm glad I know what I am doing cause the creditors haven't a clue! :rotfl:

    Well I'm now waiting for the brown stuff to hit the fan, since today I cancelled all my creditors' direct debits from my old bank account, and my bank itself will find out tomorrow that my salary is no longer paid in. Hopefully that will co-incide with CCCS contacting them all ... but either way, I'm expecting the phone to start ringing off the hook, for me to ignore :)

    The debt is in my sole name and the income that I have and have submitted to MBNA is in my sole name as well. I am offering them a payment on a pro rota payment. I know that it is very early days and I know that I am going to get all sorts of letters and phone calls but we will have to see if MBNA phone me back at all.

    If you could dig out the letters that could help I would be grateful

    i thought id saved a full letter on the pc, looks like i may have printed it off and saved my copy but not on my pc in the folder,arahhhhh techo stuff confuses me at times##

    so ive got bits of my copy and have typed up so you can incorporate in a letter

  • Hey Markey,

    The same thing happened to us wth child benefit....well it didn't actually happen because I rang them to double check CTC had contacted them. It turns out the lady from child benefit said it can take weeks/months for that info to filter through to them, always better to ring all agencies directly!!!!

    I know it's no use to you now, and I wish I had thought on to mention it in here, may have saved you some grief...still if others read and know what to do then that is good...I don't think the inter agency hotline is very good!

    Anyway you should get you money no prob from old bank, they can't keep it,

    It's a while since I posted but I have been busy.

    I have sent CCA requests to 3 of my creditors and to date, no-one has been able to supply one. So I have instructed the CCCS to withhold payment to these creditors as the account is in dispute.

    Now, whatever your moral stance is on withholding payment for non production of a CCA, I do not wish to avoid paying this debt but I do want to be in a position to offer a fairly low full and final settlement figure.

    Since the death of my husband in June, things have been tough and I still have this debt hanging over me. Believe me, creditors are not interested in your personal circumstances no matter what their "caring" blurb may say.
    DH left no money but that does not stop his creditors writing and asking for all kinds of information to which I have no answer.

    His debts died with him but you try proving it.
