    Hello - Me I did it - coz of the car too ;)

    CCCS told me to ring them all to let them know. So with a huge gulp and very worried I did and asked them to make a note that this was a one off reduced payment because of the car problems. They all said "Fine, we'll note it on your file".

    I had no phone calls at all when they actually got the reduced payment.

    The only one who was a problem was FD, who had said fine, then wrote to me to complain and say I'd broken my repayment agreement :rolleyes:. So they got a snotty letter back telling them what day I rang and that I'd asked for a note to be made on my file.

    Cue apology letter for the message not being passed between departments and a snotty message about car costs already being budgeted for in my DMP :p

    I had paid for a whole year with no missed payments at all though (not sure if that makes any difference)

    But no problems AT ALL ;) Keep calm ;)

    That's put my mind at rest a bit, we've paid just over a year so maybe that will help. I'm going to write to them all so that if they do phone or write I can say "Payplan told you, I told you". I thought I was doing so well having the £200, I think that's why it was so upsetting when it wasn't enough :o .

    Feeling a bit calmer now and just waiting for the call to go collect the car and get the exact bill :eek: .

    You did do well to have the £200 - I only had car tax money but couldn't tax it till the MOT was done and didn't have anything saved for the MOT due to previous car costs :o

    Requested copy of CCA from 1st Credit DCA last week and I received it today. Well, at least an edited version of it. Parts of the information have been obscured. They have enclosed a letter asking me to verify that it is my signature on the document and that I did live at the given address on the form. (It was when I still lived with my parents) Upon receipt of this information, they will then send me the unedited version. Is this normal practice or are they trying it on?:confused:
    It looks very basic, with little info regarding terms and conditions. Do they think that I am on to them?

Presumably they have been writing to you at your current address demanding payment and disclosing the amount you owe, so don't they think you are the right person? In which case why are they writing to you! I'm sure the advice from the experts would be not to sign anything.

    Thanks for replying. They dont actually ask me to send a copy of my signature, just for me to contact them to confirm that the signature on the agreement is actually mine. It sounds like they think I maybe thinking that I am denying that the debt is mine, which I am not. I just want to repay it back at an amonut that I can afford without the risk of them taking me to court and trying to get me to sell my house!

    well thats a new one on me,lol

    have you registered on the www.consumeractiongroup.com forum, there have been lots of good legal advice given to me, and this i believe posts saying they do not need to see your signature or have your signature to provide a cca, to me it shows they a pulling a fast one, im sure there is a letter that states about the original creditor does not need to view a signature to provide the cca, but i will come back to you in a bit,,, ciao for now maz:cool:

    I would say they are trying it on, there is no reason for them to do that except to get you to admit that is the document you signed, and whats betting the hidden bit contain something in there favour that wasnt on the real agreemant, but too late once you have confirmed in writing

    Wish you could post a scan of it, could be intresting, but you would need to edit the bits that would give the game away :rolleyes:

    hiya ive sent you 2 pms hope they still help

    at the end of the day a true and valid credit agreement will have the correct information with your signature , dont assume anything with any DCA , they will make an !!! out of U and me - lol

    it is your legal right to be sent a copy the original copy of the agreement and if the dca bought the debt they should have ensured they had all the correct paperwork, if not that s their problem not yours. If they cannot provide the cca to you then the account is in dispute, and they should either send the debt back to the original creditor for them to deal with your cca or advise you they cannot provide the information to you

    its not about avoiding the debt but to ensure you are paying the correct debt and with the correct terms

    That was my electronics tutors favourite saying, and quite apt when dealing with high voltage stuff:eek: :D
