Hello,
This is the first time i have posted on this thread but need some advice about my DMP with CCCS. I have been dealing with my debtss this way for about 3 years (about ten more to go, unless i win the lottery or marry a rich person!) but this year i had to drastically reduce agreed re-payment amount re no payrise and everything else going up. All companie are ok except Evans store card (GE capitol). I am currently not opening the post but this will not work and i am inspired to tackle after reading some of this post. They are not happy at amount of payment and are applying charges left right and centre and have re-instated account protection despite me confirming in writting that i want this off the account. Prior to ignoring post i have rung them loads and told them CCCS but no joy. Finally opened most recent letter and they are serving default notice if i dont pay an extra couple of quid a mnth. This will put how DMP in trouble as live on my own and budget is tight already. Sorry to waffle. Can anyone advise on what my best course of action is please. Incidently this is smallest debt of the lot but the most trouble!!!!!

The best thing that can happen is that they default the account, because if they do, then all interest and charges will stop being added. The debt will then probably be passed to a debt collection agency who will be more likely to accept the lower payments.
As for the ppi insurance, they cannot restart the payments for this if you have confirmed that you want it stopped. This is similar to ppi mis-selling. Write to them or phone and say that you will start an official complaint to the Financial Ombudsman if they continue to take them payments. Was this policy mis-sold to you in the first place? If so, you might consider reclaiming all the payments back. Check out the reclaiming threads on the site for more info on this, including Martins step by step guide.

hiya all
ive not posted since last friday after my horrendous incident at lloyds, but feeling fab today as ive finally got it all of my chest - and sent them a complaint letter for the way i was treated.
so will update you all.

i noticed Sunshine38 - you had a post about credit card agreements. well, i am also on the forum for consumeractiongroup and have found lots of legal stuff there i didnt even know excisted. Whilst this site is also fab, ive made some fab connections there that have taught me such a lot about our legal rights, im addicted - lol im sure hubby thinks im having an online affair, no im not honest! haha

ive been concentrating on my own accounts this week and sending for all my cca and now reading up on claiming the charges too - all to reduce the debts

Sorry to keep flooding the forum, but I have another quandry.
I am tied into an orange contract that I don't use at all (after a freak £200 bill of data charges). Its £25 per month, and I've got over a year left on it.
If I'm getting defaults anyway for my DMP shortly, do you think you can just say to a contract phone provider that you afford it anymore and ask to have a default? Or do I risk really ballsing up my credit record and face court etc?
I already have a default on a payment with them 6 months ago when I had this silly bill, and went on a repayment plan with them. Or, whilst I'm paying each month on time with a DD, I'm getting green ticks on my credit rating. ummm.
What to do.
I also had a Contract Phone with Orange, I had 6 months remaining at £35 a month. My bills were always going over the £35 a month so I stopped paying them. They have now referred the remainder of the contract to a debt collection agency and I have added it to the DMP. CCCS were allowing me £35 a month for the contract anyway, so I've now reduced it to £20 to put no a PAYG SIM and the other £15 has been added to my DMP to increase my payments slightly. I had a Dorothy Perkins account with GE Capital, and they were a pain in the bum. To be honest, I know they're a pain but leave them rant and rave for as long as they want. If they default you, so what! At least you'll be with a DCA who will accept your payments no worries. I am not sure Martin is right on this one, Lloyds HBOS merger. They are talking about a lot of job losses and closure of branches now when Lloyds and TSB Bank did exactly the same then we have the situation now and also C&G this year became Lloyds proper.
But I don't think we need to panic now I think it will take time and they do have to write to warn you that the banks are now one, like when C&G became Lloyds proper.0 -

I was just wondering about interest. Whilst all of our creditors have been accepting payments from us via CCCS for almost 3 months now, some of them appear to be adding interest which we assume they will want paid at the end of the term. CCCS told us that after 3 months we could ask them to stop charging interest. Do you think they will agree to this?
Also, one of our Lloyds TSB loans has told us they will accept payments for 6 months and then will expect payments to revert to what they were before our payment plan. Realistically will they do this or is it just an empty threat? We have two other Lloyds TSB loans and we have not heard a dickie bird from them, they just seem to have accepted the plan.
Once you have a company accepting payments not matter how long for they have weakened there position and it is much harder for them to refuse. You know Lloyds they may roar a bit and moan but they will continue it.
I would definately give it a go at moaning about interest, you have told them you are struggling so they should co-operate more. Its a case of nothing ventured nothing gained.0 -

Mint loans only accepted for 6 months. Then after the 6 months they asked me when I could increase payments - I said not likely as even if I changed jobs it would mean a drop in wages. They said ok and sent me a default notice.
Nothing else from them (and a whole year after that default). Not been assigned to debt collectors, no court action, absolutely nothing - they just take payments each month - the 6 months agreement and subsequent default notice must just be red tape stuffworking on clearing the clutterDo I want the stuff or the space?0 -
Thanks for that, JES F1, I have drafted something similar so I will also add the Payplan phone number to it.
