    Hi Maz1964, thanks for that. I would appreciate some help with the letter if you have one. Would you know whether I send it to the original creditor or the DCA? I'm not trying to avoid paying the debt, I just want them to lay off with the threats and if they realise that they actually havent got a signed copy of my agreement (which I'm pretty sure they wont have) then they may just play nice and accept the payments being offered without any more fuss! I'm tired of the bullying tactics.

    Most debts eventually will go to court and will result in a ccj, I think this is the only way you can successfully get all interest and charges stopped as the debt at time of going to court is final and that is what you have to pay, no more no less.

    Jeez, is this true? Does that mean that my 5 years quoted DMP definitely WILL end up with CCJs in there? Does no-one successfully complete a DMP without CCJs?

    Quite depressed now ... !!!

  • i have just been sitting here this morning getting some ifo together from t'internet with regards balances etc etc and its so scary.

    I owe my parents and my son money too but they have said not to worry about that for now. Should I include that in my CCCS list or not???

    I know they will be both be happy for me to just pay them a little something every now and again without having to commit myself.

    I'm just so confused

    I want to have a declutter and use the money from that to repay my parents and son? is that an okay thing to do???

    :cry: Can someone please stop the world - I wanna get off. I don't like this ride no more :cry:

    I owe my Dad money too and although he is happy to wait I've budgeted to pay him off £50 a month (I owe him about £4000 altogether!!). It's allowed by CCCS as a loan from friend/family member. Just make sure you don't under budget for anything else either, be realistic about your budget as the idea is to be able to live again!!

    Most of all, don't worry, it is hard but it's the best thing I ever did!! :D

    Do CCCS pay them for you and you pay your fixed amount to CCCS? I think they would be happy with this

    No. They take it out of the equation as such. When you give all your details about food budgets, utility bills you give this amount. They ask the monthly amount and the amount you owe in total. They have never queried the amount I pay. I then pay me Dad directly every pay day. Obviously if I'm gonna have a tight month my Dad would waiver it but at least there's a provision there for him to have something back.

    I don't think that's right ;)

    I'm 18 months in and no sign of a CCJ. Had some default notices which is where interest has stopped. If they went to court, the court apparently wouldn't look too favourably upon them since we are actually paying in accord with the DMP and what we can afford. Of course they do still have the right to take it as far as a CCJ but if they are actually getting some of their money, they aren't so likely to since it will cost them court fees - surely???



    Anyway, on another note, had a letter from First Direct who are "most concerned" they haven't received my "repayment agreement" which incidentally is entitled "Fixed Loan Agreement" :rolleyes: and me agreeing to it means I'd be agreeing to pay the full amount off on the final instalment in one year's time - I only wish I could guarantee to have £5k spare by then :rolleyes:

    Debating ignoring them, or sending a snotty response :p

    hiya sunshine, ive sent you a pm and included my letter and what ive done in reply to above,

    it is exactly why im requesting this too, its my legal right and im fed up with them too, so far mbna have been total muppets, supplying current terms and this is not allowed, they must think we are idiots, so therefore its not about not paying but to stop the actual bullying tactics they use, and my next step is looking at reporting them to the trading standards if they dont comply.

    so keep you all informed, i know we all do want to pay our debts me included do not think i dont. However, i feel debtors like ourselves get treated like the ones who dont even pay a penny.

    There was an article in one of the sunday papers about government law being looked at to be passed - dont know when but i recall if so, it will actually allow creditors to go for the charging order bypassing the ccj and maybe even forcing house sales!

    I will try and find the link and post, so im so incensed with this, that us homeowners will end up possibly with charging orders for unsecured debts and face the real threat of losing our homes. The charities are already speaking up about it, so another reason why im requesting all my cca, for the time being looking at all options.

    Im making an appointment with my local councillor ref this. Im a woman a bit mad, on a mission now.
