I paid by Halifax CC and have now received a refund - Phew. Good luck to all those still waiting.
• Hi I am sorry that I have not posted earlier but there was nothing to add. Sussex police are actively investigating this and also linking it to a similar scam - best sports world - that I alerted the investigating officer. He is in contact with me so hopefully if they catch the !!!!!!s he will let me know first. that is if they can get them. My reason for posting bar I guess for most, a useless update, is I want to see if I can help people who have been refused a refund.
I am still getting phone calls and emails from people. Most have been refused a refund from their bank. I think most people have got a refund but if not, with my limited powers, I guess I go after the banks now. People should be covered by the banking code of practice but I am not a lawyer. So if your bank has refused a refund would you let me know. I can't help each person on an individual basis =- I am sorry - Please don’t phone; I am seriously busy as a news editor - email me with these details
- your bank, your branch, when did you buy a wii fit or other product (the actual date), when was the money taken from your account,

Did you ask for a refund in a branch - ie go in person, or did you call a 'central' number, the date you were refused, , what were you told by your bank.
There may be some loopholes in the banking code or practice - but many people got refunds no prob with debit cards; others I know have been told tuff and it is not just visa card users!
I am on holiday for 2 weeks from 15 august but will try my best to find out why some people are being refused a refund when others can get one. I promise nothing. But I will do my best
Put in the subject line Zavvi direct - refund refused.

• i received a phone call from the bank yesterday saying that they have taken the money back from me as the retailer contacted my bank and provided paperwork to prove that this wasn't a fraudulent transaction.. i asked the bank to forward me this paperwork but they refused. i then said ok, if they have proof, now ask them for proof of postage when they 'supposedly' sent my wii fit.
the useless lasy on the phone said it wasn't within her power to contact the retailer and as far as HSBC are concerned, the case is now closed.
• I too have spoken to the bank today. Zavvi-direct have requested the money back so I am now out of pocket! How can this be? If they have turned up shouldn't they have been arrested??
• Hi - most people appear to have a refund from their bank but I have just had two emails from different people (thanks for letting me know about this) who said they ordered from zavvi direct - their banks have apparently contacted them to say zavvi direct has been in contact - with proof - it is not a fraudulent company. This is very odd to say the least - as I talked to the police on monday this week and they have linked this to the other company I mentioned and YET another one - I have let the Detective in charge of this fraud investigation know about this very odd development but if anyone else is getting the same feedback from their bank please let me know. I need to know if you paid by debit or credit card, who your bank is and your branch details.. if you were contacted by branch or central bank customer service and what the bank said - ie what proof do they claim to have.. we may have found a ludicrous loophole that has allowed ths lot access to this.

• Dinah, I placed my order for a Wii Fit on 12 June 08 and paid with a LloydsTSB Debit Card. I chased the order on the 24 June and was told 'stock is due, please wait'. On the 7 July I chased again and found it was a scam. Having contacted Protx, they said contact your bank. After speaking the LloydsTSB they said no refund as it was paid by Debit Card.

After a bit of research on-line at that time, it appeared that the scam companies accounts had been frozen on the 8 June, thus the anyone paying after that date (i.e. just like me) could have their money refunded. I raised this with the bank I they said they cannot do anything, it has to come from the company?!?

I tried the Citizens Advice Bureau, but they just referred me to my bank again...after going around in circles for the rest of the day I gave up.

My money must be in limbo somewhere, but I have no idea how to retrieve it.

Can you offer any assistance?
• Hi contact your bank again - just because you paid by debit card shouldn't mean you are not covered - the banking code of practice should see to that - if however Lloyds continues to refuse this let me know at dinah.greek@incisivemedia.com
