here is the story so far.....
I had a cap 1 card years ago with credit limit of £200 i missed payments and i defaulted with them at £488. In 2007 i started making a claim to get the charges of the account back. in this time they sold the debt to lowell and cap 1 said they will repay the charges of £779 but will be making a payment to lowell of £488 and sending the remaining amount to myself. Well i declined as cap1 dont have the right to make payments to 3rd party companies and i was going for full amount to be paid to myself.
Lowell removed the default off my account on my experian file and cap 1 started to dig there heals in. Now cap 1 have put the default back on my account dated for 2003 so it is due off this year. I know now i should of just accepted there offer and walked on and now am out of pocket due to court fee's etc.
I am going to write to cap 1 asking for the difference and see if they will remove default cause it was english courts the case was in but i can file the case in scottish courts now if they dont accept the above.
Alot of people i spoke to saying it was 75% in my favour and am shocked that i lost.0 -

Yeah...hindsight's a great thing! I think if we all knew then what we know now, then we would have jumped at the chance of them paying Lowell the £400 odd and giving us the remainder....but we live and learn.
So what are the court costs? Are they high? Do you have to pay a one off fee?
Do you live in Scotland Fairmorn? Is it possible to transfer to a Scottish court? Would it make much difference to the outcome.

yes i live in scotland. i wouldnt get it transfered to scottish courts i would start a brand new claim.
Court costs ended up nearly £200.
Going to have to wait and see to a friend who is very clued up on these things to see what he recommends to do from now on.0 -

Well Guys, it looks like I'm not leaving the sub prime world after all. I'm not going to remortgage with Abbey, am gonna stick with SPML/Capstone (:eek: ) and take advantage of the tracker that I'll end up on when my fixed rate ends on 31 Mar. If the Base rate stays as it is now, I'll be paying £250 less than what I pay now :j And that will go straight in my overpaying pot so that when house prices eventually rise again I can get a half decent deal.
So...........because I don't have to worry too mcuh about searches on my file I fancy applying for something!!!!!!! What do you guys suggest. I want something juicy and really worth my while lol. It's been so long I feel like a credit virgin again lol0
