  • Theoretically you should be able to get either an exchange or a refund with your receipt even when it has OC refund on it, as the sweetner for the overcharge should not effect your statutory rights.

    Although I think that they'd be absolutely furious about it if one where to try it. I reckon never mind the CS wanting a punch-up, the manager might join in ! :D
    Drat and Double Drat, curse that Mr T excuse for not giving me a refund. :rolleyes:

    EVERY LITTLE EXCUSE HELPS in trying to get out of the R&R policy when the law has been broken, especially on high value items. :D

  • By giving you an overcharge refund, they should not have interfered with the normal rights you have if the product was bought without an overcharge refund. If you have receipt and do not wish to keep the product it would be normal to return it with the receipt for refund. This is normal tescos business practice not statutory but one could conclude it is the normal practice thus a precedent is set, also it's on the board with the OC policy (28 days blah blah), it would be difficult for them to avoid it if you were really prepared to go through the hassle/argument, etc. A statutory right would be if the said PC developed a fault, you'd have cause for an exchange/refund/repair, etc.

    Although I suspect that if you did try this they'd be more than well annoyed !! :D

    Even though they have issued an overcharged refund, I can still take it back because I don't want it, and they will have to offer me another refund? I like the idea of that, getting another load of £448 on my credit card, or even if it was £349, fantastic!

    but why wouldn't you want it - you got it free. Look at it from their perspective and that is what they would think. I wouldn't be at all surprised if they just gave you back exactly what you paid for it....i.e. zero. I'm sure that is all they are legally bound to do.

    But in the case of a change of mind, I think they could reasonably argue that the refund would be for the amount you paid - ie nothing.

    However, if the goods are faulty or become faulty you'd be entitled to an exchange or repair.
