    Hi Badger_Lady,

    I'm just wondering how your new plans fit it with this HMO stuff. I know you said before that your local authority doesn't consider you an HMO with three unrelated occupants and three floors but does that still hold when you add Mini lodger and go up to four unrelated occupants by having three lodgers? You will have to remain an official occupant when when you are away or else the lodgers turn into tenants.

    Actually that's another question, can you get that to work out? Tessa's site has been linked to already but her examples are going away for a few weeks and moving out permanently. Your travels seem to fall somewhere in between.

    Yep... all three lodgers are allowed under my local authority's HMO rules (that's the maximum though). And aside from that:

    - I will not be leaving the country for any period longer than 6 months and will therefore remain a UK resident, with this house my only residence in the UK.

    - The cleaner will be continuing to visit every week and has been instructed to clean inside the lodgers' rooms unless they ask him not to (by putting a sign up or locking the door).

    - Already it's been made clear that people need to move to different rooms within the house - even if it doesn't happen much in future, a precedence has been set with the swaps that NakedChefLodger and MiniLodger are doing over the next month.

    - I have a key to all the rooms.

    As well as these lodger / tenant considerations there are new tax considerations, because I will now be well over the 'rent a room scheme' limit. However, it will be my only income for a while so it should come into personal allowance - I just need to complete my tax returns.

    so they will be tenants then. Isn't that the case with HMOs

  • Reading through Franklees link I got the feeling they are lodgers.

    They don't appear to be related (not knowingly anyway :P) They can be moved around to different rooms at any time, BL has keys to those rooms and also BL isn't going to be out the country for more than 6 months at a time.
