    am subscribing to this thread too. started reading at almost midnight and read the whole thread slowly till early morning. was feeling sleepy hence the slow read but i couldnt log off till i read the last post.

    just one query. since the lodger had some sort of a rental agreement and the rental agreement was on till the 10th. wasnt the badger lady breaking in and entering the tenants room to evict him. i was under the assumption that u cant take the law into ur own hand however much u were provoked and if needed to evict a tenant u had to go to court if the tenant did not vacate. wasnt that the obvious things to say or am i missing something here.

    hope u dont land in trouble badger lady for entering the tenants room without his permission and removing his belonging and ?? illegally evicting him. or am i wrong in this assumption. also do lodgers deposits get the same protection as rental deposits? do they need to be under a DPS as well???

    best of luck badger lady. i do hope u get rid of this bum soon and without further trouble. what with all his excuses flashy car etc he looks all the more like a professional tenant out of hell.

    when i do buy a house, i was wondering whether it would be possible to let out a room to help with faster mortgage repayments etc. but guess now wont be doing that even in my nightmares seeing what trouble people get from some lodgers

    yes i know it sucks u in. hence i feel badger lady would do well to step back and have a second thought before following any 'advice' given on any forum. even though that 'advice' might be well intentioned but following that 'advice' might actually cause more trouble and might be illegal in some circumstances such as illegally evicting people how ever much trouble the lodger gave you.

    hope the badger lady doesnt fall in trouble for this ??? illegal eviction of the lodger.

    Hia - live-in Lodgers have far fewer rights than other tenants. With regards to entering his room:

    1) Yes, his notice period was until 10th, but he and I agreed on an early termination. Therefore, from that date (which was about 3 weeks ago now, wasn't it?), the tenancy agreement is void.

    2) Even if the agreement wasn't void as above, there is a clause that states it becomes void if rent is more than 10 days late.

    3) I informed him of what I was going to do - I texted that I was going to enter the room and remove his things, and waited for his reply which included no objection to me doing so. This negates the "without his permission" bit.

    4) He already lives somewhere else! His toothbrush has been gone for weeks, so it's not as though I'm throwing him out on the street.

    All in all, I think I've actually done him a huge favour - I've released him from the obligation to continue paying room rental, and I've sacrificed my own Saturday afternoon clearing out his stuff for him. It'll take him half the time now to just pick up the bags from the front room. :p

    BL you are far too nice, get the junk chucked on the front garden, text him and put 'Your stuffs on the front garden awaiting collection, i will not be held responsible for items missing from this if you do not collect it by 6pm today. I would like to thank you for your custom but quite frankly the thought makes me feel ill. I wish you all the best in your 'penthouse'...*coughs* studio flat.'
