It goes to court because BG decides to be petty, BL says "He came on the 20th, 1pm!". BG has friends/a shop receipt/other proof to say he was halfway across the country at 1pm on the 20th and couldn't possibly have collected the stuff, BL is now in trouble. Not worth the hassle.0 -
Okay, so what to do on Monday morning is still in question... but remains a hypothetical situation.

Possibly, but would he want it to go to court? Firstly they would most likely ask why he hadn't collected earlier but secondly BL could bring up the issue of monies owed.0

A couple of years ago I had a lodger at my house who was always at least £400 behind with the rent. The situation was complicated because I was away from home caring for a sick relative (my son allowed the lodger to move in).
On here I was advised to get home pdq to sort it out, as several high-count posters were of the opinion that I may have unwittingly set up a tenancy through not having been at home for the eight weeks or so this person was in residence.
My lodger promised the arrears and found another sap willing to take them on. Then followed three or four days of possessions being removed each evening, until the night they took their cat. The money was promised for the next day but it was obvious the lodger was doing a runner - so I took back the key. They never returned, but had left about six boxes of stuff.
Again on here, I was advised that I had to keep it for three months in case the ex-lodger returned to collect it.
They didn't, so the lot went on Freecycle thirteen weeks later.0 -
Add the cost of him taking it to court though and would it be worth it?

Is there any law that states BL has the right to sell some of the goods to reclaim monies owed?0
