    Okay... I think I have to send BigGunsLodger another warning message today. It's starting to drive me nuts! I've ordered all my food shopping for 'Christmas II', bought all my presents and wrapping paper etc, dug out the stockings... but thus far still don't have any promise of a bed for my sister to sleep in! At this rate we'll all be in the campervan :undecided

    So what do I say? Just remind him of his deadline? Threaten him with an eBay auction? Grrr.

  • I would keep it brief and say something like:

    "Hi, just to remind you that your possessions will be kept here until day X, after which I am legally allowed to dispose of them. As per my previous message, I shall be around on day XYZ at time XYZ, please confirm when you are coming."

    Can you move his junk into the campervan to free up the bedroom? Maybe a short but sweet email, "Just a reminder to let you know that Monday's deadline is fast approaching and I've yet to hear from you, can you please confirm which day this weekend you'll be over to collect your property." - don't offer any alternative plans/dates or offer to keep the items, he's had plenty of time to sort something, he's just being lazy.
    Would you be able to/willing to take his stuff to his parent's house, as I vaguely remember you saying you knew their address.

    Oh, and don't know if you've already thought it, but I'd perhaps spread out his valuable looking items so that there's something valuable in each and every bag. Might prevent him picking and choosing bags and lumbering you with his rubbish, just tie everything up and tell him you don't know what's what, and don't let him start rifling through bags removing items he wants. He takes it all or nothing (and you sell his valuables to recoup your time sorting it all/costs sorting out his room)

    Yes to both - 75% of it would go in one trip in the campervan. I've actually memorised his parents' address now :rotfl:But then they do live a quarter of a mile up the hill, so not hard.

    I'm making a sure bet that he'll reply saying that neither day suits him and then go off on one about his "legal rights" and that you can't get rid of his stuff!

    However, have you actually checked the legal situation as I thought there was a much longer period that a person is obliged to look after personal belongings before discarding them than the few weeks you've given him?

    I'd just dump them in his parent's front garden -take photos of them there to prove they were left there (turn on the date & time feature on the camera) if he doesn't show up by the deadline.

    Don't know if BigGuns being a lodger rather than a tennant would make a difference though. This seems to suggest that the Torts Act applies but suggests a 14 day notice - perhaps the longer period is only applicable for tennants?

  • I would not even consider taking his junk to his parents' home and dumping it in the garden. That could be very risky indeed. B_L you need to read the link provided very closely and any others you can find. You may still have a legal responsibility to him and his stuff for some time. Just texting him and giving him a deadline I doubt gives you the right to either leave stuff out in the open air to be damaged or stolen or dispose of them quite so soon. Caution!

    BL didn't just send him a text, she sent a letter, by recorded delivery, stating all the required information and has given him a "reasonable" time period to collect this stuff.
