Scammed on ebay

    Did you pay using Paypal funded by credit card? If so phone the credit card company and do a chargeback.

    I funded it by bank transfer unfortunately. I had a word with my bank and they said that they couldnt do anything as i had authorised the payment. I cant beleive that this is allowed to happen.

    It may be worth taking paypal to court.

    I assume that paypal/ebay stressed how safe paying by paypal on ebay is on the text of the auction somewhere?

    I cant help but get the feeling that it might be all my fault. If I had read the listing properly it wouldnt of happened. This is where I fear the law may stand on this.

    These scams are getting less and less common as people are becoming more savvy to basic cons.

    However, whilst there was an obvious intention (at least to my mind) to deceive, you did actually get what you paid for and this is going to make it difficult, if not impossible to get your money back. You've already lost a paypal claim so can't open another, your bank won't be responsible so that basically leaves you with the small claims court or the police. Even then you may well run into problems as you still have the problem that you got what you paid for and if you had used basic caution, ie read the auction you would not have been conned. It might well be worth a try with th epolice, especially if you can find any other buyers that have been conned and get them to complain as well.

    While you organise that you can make a complaint to ebay, although this won't get your money back it will hopefully bring this seller to their attention. Report him for misleading title at the very least, as well as wrong category and everything else you can think of.

    I don't think they will, this is an old trick and thewhole point of it is to obtain money by deception.

    Will ebay/paypal give you the name and address of the other party?

    I'd still pursue paypal, as well as contact the police and lastly the tax office, as I doubt your "seller" has been declaring his or her extra £420s.

    Probably not in all honesty as although there is an intention to deceive the auction still required quite a large degree of negligence on the part of the buyer.

    As there are no completed listings with this title I am also assuming this all happened quite a while ago, so chasing the seller down now may prove difficult and you need to be able to find him to serve court papers.

    Its worth checking out to see if its legit and if it is then go for it.

    I was watching Judge Judy a couple of months back and they had someone on there that got scammed the same way. They got there money back.

    I would find out about taking them to small claims court and make sure next time you read descriptions properly.
