Scammed on ebay

This will make me look a bit stupid so im ready to be told so but i bought some festival tickets on ebay for £420. Only it turns out that it said in small writing that i was only bidding on a picture. I realise i should of read it all carefully but i didnt and hind site is a wonderful thing. Paypal have refused my dispute and I was wondering what I can do. Did the seller break the law and what are the chances of them getting done for it or am I screwed? Is there any way I can get my money back?

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    One for not as described. I did receive the picture so i couldnt claim I hadnt received it. The advert made it look like the auction was for tickets not a picture but it did say in the description, just small and i didnt notice.

    This is the part of the text which tells you its a picture. Id rather not put the whole thing on for privacy reasons. Prior to this is a load of text describing the tickets and who is playing at the festival.

    I can't believe people can get away with doing that! Surely Paypal/Ebay should be able to help you. I really hope you get it sorted out soon.

    What did the title of the auction say?
    "tickets for X festival"?

    It is an out rage. Iv done a bit of reading up to find out if anyone else has found a way of getting their money back and the stance of ebay/paypal seams to be that as long as they get their fee they dont really care about the buyer.

    Did you pay using Paypal funded by credit card? If so phone the credit card company and do a chargeback.
