Hi folks, not been on and posted for some time now, guess its because av never heard anything in quite sometime now, last letter was dated 28th May. The phone rang last Sat with a withheld number and never thought anything of it, so i answered it. Cant remember what company name she gave but it was all to do with this CRAP. She was wanting me to sent up a payment scheme  so a told her where to go :T:beer:, and that fitlife or whatever they are calling themselves now can go get knotted cause they are in NOWAY getting money from me:T:T. At one point she was quite rude as i was explaining the situation and how i come to be where i am with the company. I told her about the flyers and how they are illegal and at no point was i ever informed i was entering into a credit agreement or given any imformation regarding same! So in the end she said 'i will go back to my client and tell them this information and if your not paying then they wil prob proceed to court action' so i told her that her clients can do what ever they like cause they are still NOT getting a pennie from me. i have tried a few times going into Cit Ad but they are ALWAYS really busy, .....wonder if they people in there are in for the same thing :rotfl::rotfl:.

Has anyone ever checked thier credit file to see if this bloody company did a search on us or shows that we are in a credit agreement with them? Would be great to hear from anyone with this information.

Anyways, if we stick together united we shall beat these bass.
    Cheers.

nrmh02...i must have had the same lady ring me up, she was from a company called 'empingham'....I asked for her name and tel no ....'Sarah Duffy : 01536276446'. I explained as you did about the flyers being illegal and also that i did not know i was signing a credit agreement. I also said that i was in an IVA which means there is no way that they do credit checks!! I also told her that it is illegal to enter someone into a credit agreement who has an IVA!!

I also told her that i will say the same thing to her as to what i told fitlife/amc, i do not want to receive anymore correspondence from any of them unless it is a court order or a court summons. She replied to this saying that the debt collectors can still come round to collect the debt without a court order!! Once I told her that this is illegal, she replied no it is not because she used to be a lawyer!!! (wonder why she is now working for a dodgy debt collection agency).

She then had the cheek to say, 'so will you be setting up a payment scheme?'

I basically told her where to go and that i would not be paying them any money!

Remember they can not do anything with out a court order or summons, and I doubt very much that they would get one of those!!

Also, from having an IVA, i have received plenty of letters and phone calls from debt collectors. Now, almost all of them contact you very quickly and they do not use 2nd class stamps or 'withheld' phone numbers. This all started for me just under a year ago, if they were gonna do something they would have done it by now, not pushing there luck thinking people are gonna give them money!

:rotfl::rotfl::rotfl::rotfl::rotfl:PMSL!!!!! Yes i wonder why shes working for a collection agency.

The called my friend the other day as she went along with me to that fatal day. She said on the phone about setting up payment and asked her how much she could afford to pay, my friend replied 'well...let me see, how much do you think a single mum and student could afford to each month. the woman replied £100. What a joke eh, clearly no any savvy.

The woman a spoke to really didnt impress me or make me think she belonged to a legal team, ie, lawyer, cause she asked me why the flyers are illegal????.
Like a said before no one is getting a pennie from me.....EVER!

I will keep everyone posted though.

    Cheers.
  • Boy am im a glad i found this thread, i too am another victim of these fraudsters, iv recently been made redundant, when asking to cancel as i can no longer afford the payment they assured me that its not possible as i apparently signed a "non-cancelable" contract, they never told me that, infact they didnt tell me much of anything, they just sweet talked me into signing, i too am from gloucester, they really did damage here didnt they, im still waiting for thier reply to my last email, i have already cancelled my Direct Debit and i urge everyone to do that too, if i dont get my agreement cancelled then i will going to the citizen and i will campaign to get them shut down, what they are doing is fraud and i urge evryone else to report them too.
  • I recently discovered that my elderly parents had been sold a gym membership as a "prize" by this company.

A few months ago my father was diagnosed terminally ill, he was concerned as they wouldn't let him cancel the membership, but he didn't feel well enough to go! (He had trachea and lung cancer bless him). Mum visited the CAB but decided to carry on paying as they didn't want a bad credit rating. When I discovered this, I took the paperwork and wrote to the company asking them to cancel the membership. I also asked if it was ethical to sell a 3 year gym membership to 2 elderly people (80+).

Their response was unbelievable. They said it would have been ageist not to!! Despite requesting them not to, they continued to write to my Mum asking her to re-instate the direct debit and transfer the membership to someone else! I wrote again last week and said Dad was in a hospice and wouldn't be alive much longer. They responded to my Mum with the same request to reinstate the direct debit!

Dad died on Saturday. I have written to them today and you can imagine the tone of my letter. After finding this thread I still feel that they will continue to pester my Mum. I live near Southampton and feel like going down to this address in Itchen but I fear I will end up in trouble, I am so angry!!! Can we not close this company down? What are the Trading Standards doing about it? This seems to have been going on for a long time, and more people are getting conned.

  • Hi Everyone
Your gonna love me, but I have been to a local gym tonight after a cold call telephone call, saying that part of the goverment fitness plan, I was entitled to a free assessment.... anyway went to the gym looked round ( no assessment ) got took into private room then hit with the hard sell... £3.81 p/week @24 mths £10 cash admin fee.. ( alarm bells rang then CASH ?? )
Now here`s the big one, or a one off payment of £249 for 2 years membership, this works out at £2.40 p/week, now I used a gym for about five years period, this was 14years ago, and I used to go 3 times per week, and pay each night, the sum of £3.00, so to sum up I was paying £9.00 p/week in the 90`s.

So my question is, apart from the obvious credit scam they got going...
is this deal to good to be true, cause the gym I went to ( change ur Shape in Wednesbury ) look`s very good......
I am very tempted to take up the one payment offer....
    opinions please.....

ps I just noticed on the gyms own website ( type "changeurshape" in google, as I cant post links on here yet... ) they are offering a deal of 1year upfront membership usually £300.. now only £229 only 20 places available. ?????

So gym price is £229 for 1 year
AMC price is £249 for 2 years

    Regards Paul
pps please hurry lol I have only got 24 hours to decide say`s Chris my rep....

Don't do it. Coz if for some reason you need to cancel within those two years, they won't let you and you'll end up in the same boat as the rest of us.

Also, don't forget that even if you are happy to join up for 2 years and pay the full amount up front - if for any reason the gym has to close there is NO way you would get a refund - AND they tend to relocate you miles away! Sorry, but I'm just too cynical.
