    The Consumer Credit Act 1974
    The Consumer Protection (Contracts Concluded away from Business Premises) Regulations 1987
    The Trade Descriptions Act 1968

    We refer to our fax to you dated 15 May 2009 and enclose the appropriate form of authority completed by the consumer.

    The consumer’s evidence is that he was misled by your clients from the outset and was entirely unaware that he was being asked to enter into a credit agreement.

    Our initial investigations into this complaint would indicate that the consumer credit agreement is unenforceable against Mr ****** for a variety of reasons, all involving breaches by your clients of the above legislation: failure to provide the consumer with the required pre-contract information, failure to provide the required cancellation rights, failure to provide the required copies of the consumer credit agreement as well as defects on the face of the agreement itself.

    In the circumstances, Mr ****** regards the agreement as being at an end and we therefore await your confirmation that you have filed your papers. If there is any aspect of this complaint you wish to discuss, please contact me on the above number when I am next in the office on 29 July.

  • Below is what i sent to these B*****ds back in March which according to TS is when my agreements were cancelled

    Dear Sir/ Madam

    I am writing to you today to complain.
    I have received a letters this week regarding my two accounts referenced above, demanding money for accounts which I wrote to you about back in August 08 cancelling my accounts due to the fact that I was lied to when signing.
    When I received no reply to the letters and no correspondence from yourselves asking for money (considering I had cancelled my standing orders) I assumed the matter was closed.
    How wrong I was! To receive these letters demanding money 9 months after closing my account is ridiculous.
    I immediately called ECI ltd regarding this matter who told me it was non-cancellable however when I signed up I asked if we could cancel at anytime as we didn’t want to be locked into a gym membership considering I have health issues which can sometimes prevent me from working out. When I asked this I was assured that cancelling would not be a problem. We were then asked to sign, what we were told was a Standing order mandate, I later found out this was a credit agreement (which if I had known I would not have signed). The employee at the Gym managed to conceal this part of the form from us by covering it with a bright pink leaflet which was stapled in the top corner and paper clipped in the opposite bottom corner.

    Before cancelling my account I did some research online and it turns out that I am not the only person you have done this to. It turns out that you have actually done this all across the country, conning people into signing something that is NON-CANCELLABLE.
    If you persist to chase this money from me I will contact Trading Standards and Watchdog, so that everybody around the country know just what low lives you are

    I expect the next correspondence I receive from you to be confirmation of this matter being dropped

    my mum is involved in this so called credit agreement and now lyle hill have sent her a final reminder and said they will send her details to a debt collection dept. she has contacted TS in Dorset and they werent very helpful and seemed to think this is legit. What should she do now? keep ignoring them? have you all had this, she's had about 3 now from lyle hill which is why shes on a final reminder.

    members association even sent her a copy of a welcome letter asking you to initial all boxes to say that she has received a copy of the membership form, a card, and a contract - best thing about this is that all her initals and signature on the bottom of this are forged! they look nothing like my mums signature! now this form isnt too important as its not her agreement but it just shows how far ppl are going to actually push this!

    My mum is just getting very worried about her credit rating being affected and i just want some advice as to her next steps - does she ignore them or is she better off going to TS to their office and showing them all the papers/documents?

    Hello All

    Just to let you know that that Fitlife et al have finally sent my details off to Empingham (the debt collectors). I received a letter to which I replied that I had no intention of paying another penny to anybody because what AMC have been doing is illegal and I won't be bullied etc etc.

    Empingham have just phoned me at work (I was most annoyed but didn't let it show) and I explained everything over the phone. The guy asked if I could put this in writing and I explained that I had replied to their letter already - guess what, they never received it so I'm about to send it again.

    He said if I sent details through to him he will get the case closed down. I will believe that when I see it mind you.

    If anyone is having doubts about Trading Standards please keep trying. They contacted the Office of Fair Trading for me and the OFT sent me forms to complete which they are doing for as many people as possible so they can build a case against these companies and get all this nonsense stopped.

    Keep with it and do not give or they win and we can't let that happen.

    hello people, new boy in the forum.
    My partner and i were conned into signing exactly the same thing as everybody else. I sent AMC letters regarding cancelling membership, never got a reply, tried sending lyle hill and fit life letters regarding cancellation of memberships, got no response again. Cancelled S.O's in april this year THEN got response saying that we owed them and the DEBT was now in the hands of debt collectors.They have rang my partner, they have tried ringing her again and again. We have had the letters telling us that the contract was NON-CANCELLABLE (but we were never told that at the gym) and the money must be repaid. Have contacted CAB and CONSUMER DIRECT and TRADING STANDARDS, all three have said because we signed the contract on their premises we are in breach of contract and must pay up. Have explained the flyers sent out by SurveyUK, were after a court order banning them from sending anymore i still have to chase THEM and ask for proof that we owe the debt.
    We are disgusted that these companies are allowed to keep on trading and it would appear that no-one (other than us as a collective) will do anything about them. Why haven't they been forced to cease trading yet?????

    I have just heard from my Trading Standards officer who has informed me that it looks as though the Office of Fair Trading ARE going to take action against Fitlife Ltd. He said that it had helped because many people are filling the OFT forms.

    Keep with it, this could be the start of the end for all of us.

    Hey that's great news Miss LML, i'm chuffed for ya!! We, however, have been told that it looks like we are bound by the bloody agreement, and that was by Consumer Direct, the legal arm of T S. Tried contacting the OFT by phone and all they did was direct me to bloody Consumer Direct, looks like yourself and any others who have escaped these b&*^!rds have local TS officers who are looking out for you. What or how did you manage to get them on your side?
  • I was also taken in by this company. 2 years ago I was informed that I had won a "free" membership to a gym in my area but I had to pay £16.53 a month towards maintenance & upkeep of the gym. I was told that the payments were for 2 years & after that, I would get a free year. The gym was not very clean, & definitely not female-friendly. When I went, I was sometimes the only person in there (there was not even a gym employee in attendance!) & at other times, there were only men in. It was a horrible experience so I stopped going. 18 months later I tried to cancel my payments too but got the runaround by Fitlife/Lyle Hill tc. I cancelled the payments from the bank but then received letters threatening to take me to court which were rather frightening, so I reinstated the payments. Now it is more than 2 years & they are still continuing to take payments from my bank account! Help!

    Initially my partner contacted Consumer Direct and was given a reference number. I then contacted Trading Standards myself quoting the ref number and they took the case on and an officer called me for further information; he did say that I wasn't the only one in the area to have made a complaint.

    I sent him all the letters I had received (kept scanned copies for myself) and after a couple of weeks he sent me a form to complete that was to be returned directly to the OFT. Now, just a couple of weeks ago, my partner received an identical form from the OFT which was as a result of his initial phone call to Consumer Direct. Obviously I wrote back and explained the situation.

    It is all credit to these three departments though, they have been really helpful. I only wish I could help further with contacts for you but that is not allowed, please do not give up on these departments. You are NOT bound by these agreements if you had information witheld from you at the time of signing.
