  • I have received the letters as well saying 'it is non-cancellable' and i am in a 'credit agreement'.

    The strange thing is that i have an IVA.....and one of the 'rules' (as AMC like to say) is that I cannot enter into a 'credit agreement'. Now, any other legitimate company would have done a credit check before allowing me to proceed.

    After reading this enlightening forum, I intend to reply to them via e-mail stating that i have an IVA and also putting a link to this blog to make them aware that people are realizing it is a scam and tell them to stop sending me letters as I will be ignoring them!

    If they dicide to proceed, i will quite gladly go to court and my credit rating is non-existent at the moment. Im quite sure that a court would be very interested to hear that a company is claming to give people a prize, mis-selling gym membership, without letting them see the terms of what they are signing, and claiming to tie people into a credit agreement (especially someone with an IVA).

  • :confused: hi everyone i have too been conned into this stupid membership i am on the empingham stage and was wondering if anyone can give me any advice as im quite worried as im not sure whether they are a proper debt recovery please someon e help me!!!!!!! i have already written letters but maybe someone who has had a successful cancellation could tell me what they did?i have also been to citizens advice about them and they said to just wait for it to go to court some help would be apreciated by anyone thankyou xxx

  • My first e-mail to AMC after receiveing the letter from Lyle Hill:

    Hello,
    I have recently received a letter from Lyle Hill Ltd. (Ref : LYLE51-13589) regarding my membership with yourselves.
    I have spoke to them and they told me to contact you.
    In the letter it stated that I had missed a monthly payment. I had not missed a payment, I had purposefully cancelled
    my standing order for the following reasons.
    I originally received a letter last summer saying that I had won a prize, I rang the number on the letter and the woman
    I spoke to said I had won a Gold membership at Butlers Gym. I went into the gym to enquire further and I was informed
    that this was correct and all I had to pay was a monthly payment of £16.53 for general maintenance. I was asked to sign
    for a standing order, and because I asked would it be possible to cancel this at any time and was told yes, I signed the
    form for the standing order without a problem.
    Now, because I had not been to the gym since the beginning of September, I have paid about £80 for something which
    I am not even using (you would be able to check this with the gym, because they keep a record of when people use the gym).
    So I cancelled my standing order. The reason for me not going to the gym, and also for originally asking whether I could
    cancel was because I am a single parent of two children. So, I therefore have little time to go to the gym and I also have very
    little spare money. I explained this to the person in the gym, and they made me believe that it would not be a problem if I did
    change my mind.
    So after cancelling my standing order, I have received this threatening letter, which, I am now sure you can understand I was
    shocked to receive.
    So, I would appreciate if there is no further action taken regarding this matter, especially because I was originally told it was
    a prize (which I realize now, quite obviously it was not), then miss-sold a gym membership and also because you have now
    had £80 off me for something I have not used, which I'm sure should cover the cost of any inconvenience of updating my details.

    With reference to the e-mail sent below on the 23rd. I received your letter yesterday and there are a couple of things
    that are confusing me!
    I was never explained anything on the telephone, or when I went to the gym (especially about entering into a credit
    agreement). The thing I find most confusing is that if I have been entered into a credit agreement, surely a respectable
    and legitimate company would have done a credit check on any applicants entering into the agreement. If you had have
    done a credit check you would have noticed that I have an IVA and I am therefore not allowed to enter into a credit
    agreement. Also, if I had have been told it was a credit agreement any point I would have refused because of my IVA.
    Since receiving your letter, I have contacted trading standards and I have also done some other research on the internet.
    Please see the link below of the forum that has been created especially for you company. It seems like I have not been
    only one to be kept in the dark until its is too late. I also do not seem to be the only person who is very unhappy about the
    whole situation. I'm sure you will find reading the comments very interesting!

    I am not the type of person that likes to be forced into anything and I do not appreciate threats of my credit being affected
    and also demands for money.
    I do not expect to receive any more letter or correspondence, unless you are prepared to go court. I'm sure a court would
    be very interested to hear of all the people you have tried to scam, and also that you have entered someone in a credit
    agreement who has an IVA. Trading standards are also willing to get involved if this matter goes any further.

  • I think it is important to let them know that we are all not alone. I know I am not in the wrong and it annoys me the fact they think they can threaten people like this.

    firstly let me just say have fantastic it is to find so many of you in the same possition as me,
    like most (if not all) of you i recieved a letter that states ive "WON" a competition but only had a short time to recieve my prize, i contacted the company and they told me i had won a gym membership for 2, we went down to the gym and had a look round, they got us to sign a standing order straight away but i was never told this uncancellable, nor was i given any paperwork for which i had just signed, a few months later i started suffering health problems, and couldnt work out without being in ALOT of Pain. i called them to cancel and was informed that it was non cancellable, they informed me that i could transfer it but had to find someone. unable to find anyone and being the idiot i am, i kept paying, they back in July 08 due to financial reasons i had to cancel my Standing Orders with the gym, as i couldnt find any telephone numbers online, except for one that was for a completely different company i couldnt contact them, so i waited patiently for a letter asking for money so that i could get the phone number and explain, the next month went and no letter, then another, and another, getting a little concerned i tried again to find their details, that is when i found this site, after reading some of the posts on here i decided to put them out of my head, and hoped they had gone bust. but low and behold this morning (8 months) after i cancelled my standing order, they write to me asking for money.
    I have spoken to people in work about this situation and they think i dont have a leg to stand on

    any advice would be greatly appriciated
  • now that i have a letter should i try calling them again or just ignore them
