  • Gen7GT - Lyle Hill, AMC and Fitlife are one and the same.
We tried to cancel within a 24 hour period - but still was refused.
The best advise I can give is to persevere with sending them letters as to why you want to cancel. If you read this thread/forum, you'll see what everyone has received and I think there are a few example letters.

You will eventually get to the stage where they pass your 'debt' onto a collection agency (which is the stage most of us are in at the moment).

You should speak with your local citizens advise bureau, tell them about this forum and some of the other places affected, i.e. Gloucester, Sheffield, Newcastle Upon Tyne (you'll find them all here). They should give you some great advice.

We also took advice from my solicitor who explained that we haven't actually signed a contract but a credit act. There are no terms and conditions, no cooling off period and the 'contract' does not clearly state who you are dealing with.

You may also find that as you progress, Fitlife or Lyle Hill (can't remember which) will put a statement in one of the letters stating that had you contacted Fitlife Ltd within 7 days (?) you would've been able to cancel - which is a load of rubbish!!!

All in all, you will get very frustrated with this issue. I kept referring back to this site to see what everyone else is going through - it helps a lot to know you're not the only one!

    Good luck

    xx

  • I've spoken with CAB today and they have booked me in for an appointment next week however, said I need to speak with consumer direct again. I did and am waiting for them to call me back albeit was told that this may need to be dealt with as a nationwide complaint (whatever that means)?

Will speak with my husband about the newspaper idea.
    Regards
  • Well, I think this all explains why some people who used to be on this forum are no longer on here.......they've just moved on & ignored the lot...like it is said "what can they do"?

I will send my letters to the 3 (same) company with reference to the 'second' membership, wait for the Empingham letters, then send that draft from 'page 8' & be done with them!

If I disappear from this forum, it is because they did not get a bean out of me!

    GOOD LUCK EVERYONE!

NEVER EVER EVER SIGN ANYTHING AGAIN!!!! (Like this I mean)
  • Just had another letter from Empingham.
It states that "this is your last opportunity to settle this matter before I recommend to our clients to commence legal proceedings or doorstep collections.
Once litigation commences, your original debt will increase due to litigation costs and enforcement may take the form of a County Court Judgment (CCJ)."

They really do faff don't they!

I've just sent a letter to Lyle Hill asking them to set a court date - bring it on!

Can you update this thread if you hear back from Lyle Hill about a court date? Be interesting to find out what they do!!

I am at the stage now where I have a had my FINAL WARNING (big red letters) from Lyle Hill and they are passing my info onto debt collectors.

The trading standards officer I have been liasing with now wants copies of the letters I have received - I think he is planning to write to them himself.

He spoke with OFT who are obviously investigating it as a national complaint, however, it appears that they've not done much so far. He is going to chase them up through the week and see what they are saying to it.

FitLife replied to me for the first time last week stating that they have not received any correspondance from me until my most recent letter, that's probably because they have umpteen different addresses!

FitLife stated that they would have been able to cancel my agreement within 10 days of signing (well I sent my letter within 10 days) but it's too late now. But funny that, because AMC said it would have to be within 14 days IF the forms were not signed on the premises, and the people at the gym told me I had a 30 day cooling off period!!

They are all full of nonsense trying to back track on everything that's been said! For all being the same company, or linked to each other, they aren't doing a very good job of pulling this off because their stories are not consistent in the slightest!

I'm getting well fed up now.
  • Hi all,

Just wanted you all to know that BBC Watchdog called me tonight, they are really interested in the story. Now, if they want a piece of it then we cant be wrong!!!

Keep strong and fight them all the way. I've not heard anything from them for ages...not from Empingham either.

If you havent contacted Watchdog on their website then please do. The more of us contact them the harder they'll go after them.

  • Dear All,

I was contacted by Watchdog last night as well. They said they would call back again this evening if they want to take it further. I'm soooo pleased that someone's started to listen to us!

Regarding Empingham, I haven't had any letters.......not holding my breath!
