  • Ive been caught:eek: Got a survey uk form through the door addressed to me and me and it said I had won a prize in a competition:j so I phoned the number given and it was a free £750.00 membership for me and a pal to a gym we went straight down as it was a time limited oppertunity and signed all the paperwork which was put in front of us we were told that as the membership was free we had to still pay a little bit towards the cleaning of the place.
    It was only when I got home and read through the paper work that we noticed it was a non cancelable agreement if we had been told this we wouldnt have joined.
    I used the gym for a couple of months then got diagnosed with Diabetis and neoropaphy in my feet and was told not to overdo things and look after my feet so I then contacted the gym and told them they didnt want to know :rolleyes: so left it at that but cancelled my direct debit :eek:
    I then started recieving letters from amc fitlife lyle hill empingham etc saying they wanted X amount of money on top of the umpteen phone calls some which were very rude to both me and my husband on the phone?
    On reading this which I maybe should have done before going to the gym in the first place could have avoided this nightmare.
    Is there anyway I can stop these people from hounding me ?
  • I've given Trading Standards a statement now. They say we have a strong case against them and my officer has been really helpful. I've now had the call from Empingham and I've told them I have disputed this apparent credit agreement as I believed I was signing for insurance to use the gym equipment. They stated that they would refer my case back to FitLife and would not take it any further themselves as I had trading standards involved. They also pointed out that they had not taken the debt on themselves so would not be pursuing me for any money. My trading standards officer stated that should they take me to court, he would be waiting for them to attend!!
  • Just had a phone call passed to me via my wife saying that they were "now setting up legal proceedings".

    I'm not suprised to see many other names here since I posted last; I'm just a little suprised that these idiots have not yet had the sense to know when to give up!

    I sent registered letters to both Lyle Hill and Fitlife Ltd at:

    53C MANOR ROAD NORTH
    ITCHEN
    SOUTHAMPTON
    HAMPSHIRE
    SO19 2DT

    Both letters were received.

    To Lyle Hill I just said we are in dispute; to Fitlife I said we aren't paying / you are scam artists / Consumer Direct advised us not to pay / No Pre Contract Information Sheet etc etc

    We had a reply from Fitlife Ltd saying (amongst other things)...

    "We are very sorry that you should feel that our agreement is misleading or unfair. However we regret that we do not share your view. Our full agreement is just half a page and we have worked very hard to ensure that it is one of the clearest you will find, It is for this reason that it contains no small print and is identified as a credit agreement in bold type in two seperate places. We should also add the agreement warns that you should sign only if you want to be legally bound by it's terms"...
    Shame we didn't see it before signing the top copy - lol

    Now we too are being pursued by Empingham - for £500.03 (???)

  • Same as above i have sent registered letters & emails to both Lyle Hill and Fitlife Ltd & AMC.

    I too am being pursued by Empingham but for £455.73.
    I had a phone call asking for the amount i told them i wasnt prepared to talk on the phone so they sent a letter asking for it :rotfl:LOL.

  • Hi, Im form Gloucester also and i have recieved my 1st letter from Empingham threatening bayliffs etc. Any advice would be greatly appreciated. I am also up for going to 'Everybodies Gym' and having it out with Martin the owner. Im going to try and get an appointment at the Citizens Advice office in the next couple of weeks to see exactly where i stand. And maybe contact the citizen and warn others of this scam.

    hi everyone. ive just moved some weeks ago so i have been really busy. i am still in contatct with the people at my old address so i still able yo receive my mail, as i have not told fitlife of my move, and i have no intentions of doing so. i received my 2nd threat letter from eplington yesterday telling me they would add on court cost if i didnt respond to there letter.
    HELLO just cut the crap and take me to court.
    they may find me one day but who cares. im still here for you all fighting the good fight, and if we all stick together we will WIN.:T
  • Hi Kaykay21, my advise would be to contact your local trading standards officer. They have been a good point of contact for all the victims of this scam and in Gloucester they are well aware of everything thats going on. If you tell Empingham that you have made a statement to trading standards and are disputing the debt, then they will tell you that they are referring the alleged debt back to FitLife / Fitness Finance / Lyle Hill / AMC or whoever they are calling themselves now! (They are all the same company!!)
