Well I'm just waiting for my letter from Emphingham!
In the meantime, tonight I contacted my TS officer with all the details since he advised me to contact the 3 companies with a formal complaint letter.
I expect his next advice will be to contact the FOS (Financial Ombudsman Service)
It seems that all here are dithering over the prolonged stages of the debt-collectors letters & phone calls - I just wish something exciting would happen, like a court case or someone successfully ridding them from there radar perhaps!

Where have all the earlier people gone? I remember that some were alot further ahead into this nightmare than others......we need an update of some movement!0 -
By the way, my AMC card is/was valid until 2011. So it seems that they have signed me up for 3 years and not the 2 years as stated on the contract. This probably accounts for the discrepancy in the amount they say is due.:mad:0

I sent Trd Stds an email this am advising of my phone call from Cathy at Empingham last night and I think they are going to write to Empingham for me, waiting on a reply to that bit.
The £500.03 is still wrong, 12 mths x 3 = 36 (3years) 36 x £16.53 = £595.08, so I still don't know where they are getting £500.03 from???

Really interesting reading. We fell foul of this. We have been to our solicitors today as when the woman from Empingham rang she said it would go their legal department. Out solicitor has advised us that we need to write to Empingham advising them that as we were mis sold the Credit Agreement (ie it does not state on it that you have a 7 day cooling off period in which you can cancel nor were we told this) also due to the fact that the services that we had to pay the amount for have not been used by either of us, we will not be paying.
If it goes to county Court we have to defend it whereby we will go to court infront of the judge. Our solicitor said that he thinks this is highly unlikely as it will cost them more than they want from us to do this, but if it does then we have a very strong case.
Just a point of interest, when we rang just to speak to their legal department at Empingham - guess what! they don't have one and can't tell us the name of thier solicitors!!!!!!!0 -
Hi guys, there is now another company involved in ATM ASSOCIATES LIMITED these to are a bogus company i called empingham and before she got to say anything i asked if it was atm associates and guess what-She said yes how may i help you!

I’ve had no more letters but a Private number was calling me tonight so I picked up because sometimes my bf’s home number comes up like that, and guess what…it was a woman called Cathy at Empingham. Saying she has received my last letter that said I was in touch with the OFT (office of fair-trading) and asked if I’ve had any response from OFT, I have not and said so. She wants a copy (via email) of what I get back from the OFT then she can get in touch with her client (Fitlife) and put a hold on the debt collection (for how long I don’t know) She also said that I’m not due another letter from them demanding anything for a few weeks
That’s it so far, tomorrow I will be getting in touch with Trading Stds and see what the OFT have come back with (I really hope they kick A** on AMC, Fitlife etc for all of us innocent people)0 -

I was informed by one of these employess that I had a 30 day cooling off period in which to cancel. However, I was not told that at the time of joining, but 6 days later when I went in to cancel.
I wrote to all the companies involved (so far I have only had replies to my letters from AMC) and informed them of this. AMC replied stating that you get a 14 day cooling off period but this is only applicable where forms are NOT signed on trade premises. Well, of course you are going to sign on the premises!!!! They don't give you a chance to take the forms away, probably because they are scared we'll figure it all out when we have time to go through everything properly!
I have also contacted my local trading standards, who are liasing with the Office of Fair Trading. At least we have someone on our sides.
I ahve now received a letter from Lyle Hill threatning me about my payment not being received and that if they don't get it, the whole balance will become payable immediately. It was in capital letters (oooh scary).
It is a pain in the a**e but I suupose we just need to keep fighting it and stick to our guns.
I'm not at the Empingham stage yet, however, that is good to know that they don't have a clue! How can these people expect to get any money from us when they can't even run a scam properly!!!0 -
